Negligent homicide charge filed in death of cross-country bike rider Merritt Levitan

, 21, of Newport has been charged with negligent homicide in the death of Merritt Levitan, 18, of Milton, Mass.

Levitan was part of a cross-country group of bike riders struck from behind on state Highway 17 north of McCrory July 2. The crash involved 13 bike riders, mostly teenagers.

In addition to negligent homicide, Martin was charged with six counts of Failing to Properly Overtake a Bicycle causing serious physical injury or death; seven counts of Failing to Properly Overtake a Bicycle; and Careless and Prohibited Driving. The information comes from the office of 1st District Prosecuting Attorney Fletcher Long.

Negligent Homicide is punishable by up to one year in the county jail, a fine not exceeding $1000.00, or both. Each count of Failing to Properly Overtake a Bicycle causing  serious physical injury or death is punishable by a fine not exceeding $1000.00. Each count of Failing to Properly Overtake a Bicycle and the charge of Careless and Prohibited Driving is punishable by a fine not exceeding $100.00.

The Arkansas State Police and Woodruff County Sheriff’s Department assisted in the investigation.

The crash occurred in daytime. The prosecutor's office had said earlier that drug and alcohol screens of the driver's blood were negative.

Deputy Prosecutor John Bell said Martin is scheduled to appear Tuesday with attorneys in Woodruff County.
