      <![CDATA[The legal system is full of NON-SENSE.. I'm so disgusted by this so called "Justice" system.  Both sides are to blame.  In this case, what is the public defender's office trying to hide? Why the resistance? Lets not forget a man's life is at stake. If ANY ONE OF US WERE Tim Howard we'd be doing the exact same thing!!!  Heck, I would have driven the President of the U.S. insane with my pleas.  Please, stop perpetuating the cycle of injustice and turning a blind eye to the truth.. it's rather disturbing to witness such blatant disregard from so-called professionals.

      <![CDATA[According to the article, Judge Miller found that Mr Benca had violated NOTHING. So, what are we really talking about here? Attorney manners with each other? Well, "this or that just isn't done?"For those of us not in prison, we would not retain an attorney who would not listen to us, consult us, or let us make decisions about our case. We would walk into another lawyer's office or pick up the phone and call another attorney in order to find one who was more respectful of us and our legal issues. So, Tim Howard, who is very likely INNOCENT and who has already spent 13 years in prison, and whose only way to reach out to anyone without prison authorization is to write a letter, writes a letter asking Mr Benca to visit. And Mr Benca, who reads the letter and becomes concerned, does just that. But many in the legal community are now weighing in on this and saying that Benca should have ignored Howard's letter, so as not to hurt the feelings of the federal public defenders? It is possible to behave in a civil manner with your colleagues but keep a client or potential client's welfare and wishes paramount. The question that remains to be answered is why the federal public defenders did not welcome Mr Benca, particularly if their client wanted him, if Benca was doing it pro bono, and if Benca was doing it on the state level where the feds couldn't represent anyway. It looks like the answer to that question is known only by the feds, and they are not telling.

      <![CDATA[This man is on death row fighting to show his innocence... this is the issue. When a person is fighting for his life everyone... all the lawyers should swallow their pride and work together. Without Mara shedding light on these issues none of us would know about any of it. In the meantime men and women who deserve a voice sit in prison day after day after day.

      <![CDATA[Tim Howard is on death row. Give me a break. He should  be afforded all the legal support he can muster, and the federal defenders office might have really served their client if they welcomed the support from Benca and other attorneys who want the opportunity to help a man who just might be innocent. <br>
<br>
Working with Patrick Benca on the West Memphis 3 case representing Damien Echols, I saw a committed attorney who was less interested in ego and more interested in helping free an innocent man. Unfortunately, he has found  himself in a similar situation with some who seem less interested in what is best for their clients and more interested in protecting their bit of territory.

      <![CDATA[Thanks to Mara for her coverage of this.  It appears to me that Benca is the one who probably has an ethics problems in this case. In 30 years of practice, I have never heard of an attorney contacting another attorney's client. Most defendants do not know that they should not be talking to  lawyers such as Benca, who is apparently soliciting a high-profile case. I think there are rules against this.  Do not condemn the public defenders;  they do the best job that they can, usually against impossible odds.

      <![CDATA[How sad for Mr. Howard. He doesn't understand how much he's hurt himself. I hope there were ethics complaints going the other way too. It's improper to have a private conversation with another lawyer's client without his knowledge.  <br>

They put the FPD in untenable position. Too bad because the FPD is are the best group to help Mr. Howard at this point in the legal process. Hopefully all the work they've done up to now will still save him. And good for them for defending his wishes over defending themselves in their pleadings and at the hearing. That's difficult to do.
