      <![CDATA[The supreme court giveth and then takes away.  What is it about the Lakeview Decision and the resulting good that came out of it do they not understand.  Do we need to tailor an 8th grade benchmark test for the supremes to see where their legal abilities fall? Doesn't seem as if they have made it to basic yet.  And oh yea guys, basic does not mean mastery of the material.

      <![CDATA[No, Teacher, I am just talking about the law.  I would be delighted to see the Arkansas Legislature adopt  a plan that would provide equitable funding statewide, irregardless of  where the schools are located, but you can't get there with the present system, which designates local school millage as a "state tax."  Under the Constitution, it obviously isn't, and so another solution must be found.

      <![CDATA[Look, you can't equalize everything.  All you can do is ensure that every school receives an amount that will provide an"adequate" education for all its student.  "Adequate" is the term the Constitution uses; not equitable. Some smooth-talking lawyers got the Arkansas Supreme Court to start considering "equitable" in the Lakeview case, and the Court ended up "legislating" rather than interpreting the Arkansas Constitution.  The decision yesterday is an effort to back away from that decision without overruling it, because I think many of the justices realize Lakeview  was a bad decision.  If the state wants to give extra money to schools in the Delta, that would be fine, but don't take it away from schools in the more affluent areas. The Arkansas  Constitution does not require that.  Education can be "adequate," which is what the Constitution requires, without being "equitable."  "Equitable" is a legislative decision, and the General Assembly must  come up with a new formula for statewide financing of public education if that is what is desired

      <![CDATA[It would seem that the quickest way to respond to the equity issue would be to have the funding set so that the total funding from state and local sources is a level that the DOE has found to be equilible and if some districts want to increase their local tax rates, then the state should oblige them and cut back the state money accordingly. A lot more paperwork for the state DOE but that should mean extra money left over that could be directed to the community college system to allow them to pull a lot of the 1st and 2nd year pressure off the 4-year colleges.
