plainjim, it is easy for the city fathers in The Rock to disregard the FOI laws because the courts hold the city responsible and not the individual directors. Start holding the individual city officials financially responsible for decisons that they have been told are in violation of the law and previous court decisions and perhaps we will get through to their real god, MoMoney (thanks, eLwood).

Love me some Jamie Cox, but he was clearly wrong in his decision. Perhaps Democritus and Diogenes have the explanation, I've known Jamie for over 30 years and know him to be fair, decent and progressive, so I've never understood his decision, but I know more about ovaries in situ than I do about the law.

So I just got FOI materials from University of Arkansas about UAMS/SVHI merger...In the a lengthy section of the Deloitte letter of engagment it goes on and on about how "Because of Public Interest" they should avoid putting anything in writing....Hum wonder if that would in fact be an attempt to avoid disclosure and thus warrant criminal penalties just saying...Then the attorneys go on about how anything they do is considered client communication...Ok, attorney client privilege might protect some of the stuff but I don't think it protects what Deliotte is doing....

While I agree with the outcome of this case I am a little disturbed by HolyGuano picking on Judge Cox. Judge Cox ruled as best he could in absence of statutory language and guidance from the Arkansas Supreme Court. It is probably safe to presume that in ruling as he did he was aware (and, dare I say, maybe even COUNTING on) that his decision would be appealed and that Supreme Court would rule as it did. As such, it could be argued that he did what he did to force the Supreme Court to act. And look! It did! And did so admirably! We should not be so quick to gripe about judge's not handing down the decisions we want them to. That is not their job and I doubt that many who have posted here have as an intimate knowledge of the workings of the FOIA as Judge Cox did when he ruled. Cut the guy some slack and be glad that unlike some Judges in this Country (cough, cough, Citizens United, cough, cough) he displays some restraint when ruling on legislation.

I think that Louie may be talking about John Watkins, who was considered an expert on the FOI law. I don't know why he considered him an enemy, however. By the way, I have to say that I have the most respect in the world for Louie, who is keeping an independent newspaper alive in this era of newspaper conglomerates, and continues an honorable family tradition that goes back years and years--to the time when I was a young man, and that is really a long time.

As a government attorney, my advice is release everything, unless it fits without argument into one of those very narrow exceptions in the statute. I have never understood why the City of Little Rock, for instance, continues to fight the FOI law, even after all the adverse court rulings.
