      <![CDATA[@indus... yes.  Most Court Reporters have a tape backup to the help with the transcription, but the tape is not official; the transcript is.  Many depositions, especially in larger cases are videotaped.

      <![CDATA[Also re: @janeeyredite judging by the journalistic integrity of the Guardian, I suspect they wouldn't write this story unless they had hard proof of the depositions' authenticity.  <br>

      <![CDATA[Yes on all counts.  Depositions are not protected (unless there is a court order to that effect) so anything can be given to the media.  Its not my way, but it is done.  I have had successful cases (or been a part of a successful case) against PCSD and NLR PD back in the 90's.  I also count settlements as a success, which would expand that .  I have also had several losses as well.

      <![CDATA[@Oddball-thanks for the explanation! Are attorneys allowed to "leak" the deposition testimony? If they do, do they have to turn over the whole thing, or can they just pick out the parts they want to leak? It seems strange to me that they can give newspapers parts they like to report on, but no one can verify the accuracy or read the rest of the story...maybe its just me. <br>

      <![CDATA[Plainjim... as you probably know, unless there was a city policy or custom (and we can argue all day about what a custom is....) the city can escape responsibilty under 1983.  I've done enough of those in my past practice to be very wary of making a real recovery when you have a "rogue" cop, especially when there is evidence they were acting in a private capacity.  Suits against municipalities for the actions of individual officers who are not "policy makers" are extremely difficult.  Not that they should be, but that's the civil rights law (when applied through 42 USC 1983) for you.  A verdict against the cop is easy, but they are turnips, so to speak, so its worth the paper its printed on.  You have to show so much more to get to the municipality through its "policy makers."  I think folks would be surprised how shielded they are.  Read Deshaney v. Winnebago ( U.S. S.Ct) for an idea.   The law has changed since then, but not much for the better.  That's why I had to quit such cases.  They drained me, emotionally and financially.  State law provides nothing (unlike other states).   I think the atty for the family knows what he's doing, and probably can show a lot as far as what the "policy" of acquiescence might have been that lead to this.  Poor training, poor supervision, all combined, MIGHT just get there.  Anyway, its much harder than anyone who has not done such a case would think.

      <![CDATA[Depositions are not part of the Court record (well, not the PACER record), unless they are attached to other pleadings, such as in response to a Motion for Summary Judgment.  I suspect the Guardian got it because it was leaked by a party.   The fact is a deposition is official, but its not filed of record in and of itself.  Nor are trial transcripts.

      <![CDATA[I looked this case up on the federal case system and I can't find Lucio's deposition testimony anywhere in it. I thought it might be nice to read the whole thing as see if these excerpts tell the whole picture, but it isn't there.  Is it posted somewhere else?       <![CDATA[Anyone who has worked in law enforcement has known from the beginning that the shooting was unnecessary and unjustified.  It has also been apparent from the beginning that the shooter was carrying out the interests of her private employer, rather than the interest of the Little Rock PD in protecting the public. There never was any indication that the Little Rock public was in danger.  It was a "welfare check."   So a police officer goes on a welfare check and ends up killing the person about whose welfare they were concerned.  Little Rock should pay dearly for this offense.  It is one of the worst police abuses I have seen.
