      <![CDATA[Good point about putting people in awkward positions.  It's not a stretch to think that a canvasser might ask a legislator to take a petition into conference or whatever and get signatures, and that would definitely be a violation.

      <![CDATA[Amos - Thanks for your thoughts on the matter.  It's a close call on "circulation", and in the spirit of the rule, I'd suggest that elected officials should avoid handling ballot question petitions in state buildings.<br>
<br>
I didn't even know the rule existed until I found it yesterday while looking for something else.  Sen. Woods probably didn't know about it either.  <br>
<br>
But the Regnat group should know about it, since they claim to be the experts on ethics, and the rule is contained in the ballot question instructions. Putting their legislative allies in awkward, embarrassing positions - especially in front of a camera - probably won't help their cause.

      <![CDATA[@RC: I like where your head's at, but that law pretty clearly applies only where a public official is circulating the petition.  "Circulating" refers only to the obtaining of signatures from registered voters.  For that law to apply to Woods, you'd have to be able to show that he was acting as a "canvasser" within the meaning of A.C.A. 7-9-101: "a person who circulates an initiative or referendum petition or a part or parts of an initiative or referendum petition to obtain the signatures of petitioners thereto"

      <![CDATA[Sound Policy - I guess it depends on whether his action of taking control of the petition, signing it, and giving it back constitutes "circulation".  It looks like they're in the Capitol building.  It's arguable that a violation occurred.  But I'm not going to file an ethics complaint about it, just making an observation.  If I were running an ethics campaign, I'd try to avoid any appearance of impropriety with respect to the existing ethics laws.<br>
<br>
I'm still weighing the pros and cons of attaching pay raises to an ethics amendment.  It could be helpful for getting it on the ballot because of the Amendment 70 rule, but it will also add a basis for opposition.

      <![CDATA[Isn't there also a rule that a Constutional Amendment supporteed by petition of the people has to go on the ballot?  The number is a limit on the legislative braanch which, if they had their way, would have 140 amendments every time they met. I think it is related to how they act in relgion-don't like the preacher, start another church, the "9th Church of the ----" .

      <![CDATA[Over a dozen amendments have been introduced in each chamber, but there is a limitation on how many can appear on the ballot.  I believe the number is three.<br>
<br>
But by incorporating the pay raises in this ethics bill, there is a special provision under Amendment 70 that could bypass the limit for this issue -<br>
<br>
"In addition to the three amendments to the Constitution allowed pursuant to Article 19, § 22, either branch of the General Assembly at a regular session thereof may propose an amendment to the Constitution to change the salaries for the offices of Governor, Lieutenant Governor, Attorney General, Secretary of State, Treasurer of State, Commissioner of State Lands, and Auditor of State and for members of the General Assembly. If the same be agreed to by a majority of all members elected to each house, such proposed amendment shall be entered on the journals with the yeas and nays, and published in at least one newspaper in each county, where a newspaper is published, for six months immediately preceding the next general election for Senators and Representatives, at which time the same shall be submitted to the electors of the State for approval or rejection. If a majority of the electors voting at such election adopt the amendment the same shall become a part of this Constitution. Only one amendment to the Constitution may be referred pursuant to this section."<br>
<br>
Pretty slick maneuver there.
