National eyes on Huck's action against us
The most-read blog on the Internet, Daily Kos, focuses on Gov. Mike Huckabee's decision to cut the Arkansas Times off its press release list:
Arkansas Governor Mike Huckabee, considered a rising star in Republican politics and a possible future presidential candidate, is obviously a quick study in the meta-GOP game of petty revenge and restricting access of information to the public (a double play!). ...
The larger issue, of course, is not missed by the Arkansas Times, which notes: "The governor has decided to punish us for our opinions by withholding a publicly financed service." Yes, taxpayer money goes to fund a press office, which holds a responsibility to keep Arkansas residents informed of the governor's schedule, policy proposals and stands on legislative action. The burden is not on an outlet to "prove" its legitimacy; it's on the governor's office to make sure as many citizens as possible are aware of what their state government is up to.
The respected national journalism blog Romenesko also has an item about this episode.
UPDATE FROM MAX: We made a series of FOI requests to the governor's office related to news releases and mailing lists. The governor's lawyer, Milton Fine, has denied them all. Suffice it to say we think our legal position is more meritorious. We think legal precedents make it clear that "working paper" exceptions do not apply to the likes of mailing lists. We don't think it is a sufficient response to an FOI request to refer us to a website that has not always been updated in a timely manner, particularly as to such things as notice of press availability. He has imposed obstacles on us on account of our opinions. He is doing it with the public's money. We believe it's not legally justifiable. We're sure it's a stark example of the governor's pettiness. Not that more were needed.

he's such an idiot..
is this out of spite? i bet walter hussman is behind this.
why would he care? if he had any faith in his agenda and policies he wouldn't care what the AR Times thought or printed..
you would think that if he does run for president he would want as much exposure as possible. if he cherry picks his media outlets he only narrows his audience to people who already agree with him in the first place.. 30% of Arkansans won't cut it in a national election.

Can Huck prove he's a preacher? Real preachers are called to the pulpit, not to a private jet
Can Huck prove he's a governor? Real governor's provide leadership, especially during a legislative session.
We should file a class action illegal exaction lawsuit to recover the public money we've spent for the care and feeding of this big blowhard

Huckabee is a disgrace to his office and a contradiction to his so-called religious calling.
Shame on him for being so petty.

Watch him get more and more petty as he realizes that this Governorship is the last elected office he will ever hold. And he would not have gotten this gig if the previous governor had not been railroaded by thugs and theives of the republican party.

There are a lot of us outside of the metro area that also read this blog to get an alternative to the DoG, which does a poor imitation of a real newspaper.
If only the Stephens would work to give us an alternative to the DoG on a daily basis. How about a local edition of a national daily paper? Sort of what the DoG does in NWA but with qualityand a neutral editorial policy.

It is working Max, you are really doing good work here. Except, if it were true you would not be printing it. So we should all know that this is just a little way to get some negative press out there about the Gov. I think that you still have nothing and it is obvious now that you are getting blogs to do the work and not lawyers. What a laugh!
ARK. BLOG: Right, James. We cooked up this scheme. We'd get the governor to cut us off his e-mail and mailing lists. And we'd get him to come up with a statement saying he wouldn't work with us because we were not a newspaper. And we'd get his mouthpiece to lie about the slogan that appears on the front of our paper. And then, bingo, we'd have a controversy where we could get others in the press to write about us. Man, we are geniuses.

Hold the petulant little prick's feet to the fire with the FOI request until it blows up in his face. Equate Wayne Dumond = Willie Horton early and often until he has absolutely zero chance of ever winning even a primary.
Posted by: Dennis | April 27, 2006 04:19 PM
Have to disagree Mr. Boulder--I'd want to know this if the Gov in question were Faubus, Rockefeller, Bumpers, Pryor, White, Clinton, Tucker OR our present office holder. If I start up a news organization and ask to be apprised of public events as other journalists are, then the Governor's staff should provide that *just like they do for everyone else*. I shouldn't get special treatment, but neither should my requests be denied. If other journalists get the word by email, so should I.
There can't be "levels" of Freedom of the Press with *public officeholders* deciding that one news group gets better treatment than others.

I'm thinking AT and this blog is becoming a threat to the Republicans.
Kudos to you! I hope you are able to take this petty behavior and turn it into a plus for the AT. More publicity would be great, since I bet that more people would love to know about you. I know I was thrilled to find you online.

ARK BLOG say: "Huckabee is a public official using public resources. He can't discriminate and give favorable treatment to some organizations and not others"
If this were true then he would be required to give an interview to everyone who wanted one, if he gave any at all. We all this is not the case and so yes he does have some discretion as to he provides information to, if the information is made public, then he has abided by the law and the FOI. He does not have to send it to every single tabloid in town. Just like he is not required by law to send a release to each and every citizen of the state every time he does something. He sent the release out and you didn't get one, TOUGH! Go to his site and get it from there, or wait to read about it in a REAL paper. This is not a NEWS paper it is a gossip rag. That should be clear by the comments posted on this blog. Just because you have some partial bits of news in your weekly tabloid does not make it news.
And Dennis, the only action ever taken by the Gov. on Dumond was to deny his request for clemmency, so if that is the one thing that you think is going to bring him down, he is in pretty good shape. It has been almost 10 years since that happened and nobody has brought him down on it yet and it wasn't from a lack of trying.
Posted by: James Boulder | April 27, 2006 04:34 PM
EY,
Not every other news organization or so-called news organization receives the email. So it is not just the times, they are just the ones whining about having to look up something.
ARK. BLOG: James, it's hard being the guv's mouthpiece, I know. But you're no more accurate than he is in misstating the label that has appeared on the front page of our newspaper for 14 years. But here's the point: Has another medium that has requested service been denied it? We think the answer is no. Secondly, some of the services routinely provided others -- particularly notices of news conferences -- are NOT posted on the web. We ask only for the service routinely provided others. It is publicly financed. It should be available to those who request it. We should not be hampered in doing our work by a public official's retaliatory actions.

Yep. I remember that Wayne Dumond. I remember what he did in Oklahoma.....I remember what he did in Arkansas....and I remember what he did in Missouri.
I bet Huckabee will get to remember Wayne Dumond on occasion. And Huck's railroading the post prison transfer board to get that thug released to commit murder. Um.....

The AT has a great history with the Arkansas Gazette. The true pulitzer winning newspaper in AR.
With this success, the next step is to raise the Arkansas Gazette from the ashes, into a a daily, nationally reputable newspaper.

This is another one of those Banana Republic moments for the Huckster. He's currently the laughingstock of the nation and there will be more tomorrow. What do they put in Republican's Wheaties? I'm telling you Republicans are born that way just like gay people.
What a petty little man we have in Mike Huckabee! Of course he doesn't like the Arkansas Times because they don't kiss his ass all the time like he expects. Has he never opened a history book? Does he not know that what keeps government honest is a free press? Could he outline exactly the kind of press he thinks would be good for him and the Bush-Satan team?
Of course I am embarrassed for my state, but I'll get over it. Arkansas isn't running in any political contest, if I didn't love this state I'd vote with my feet and Allied Van Lines and get out.
But I laugh in Huck's general direction because I know I'll be here when the Huckster is driving his own equipment truck to his little tent revivals in Kansas. A petty little forgotten snake-handler passing the hat. Good day sir!

Surely this was discussed in advance by the Huckabee team. You know his lawyer looked at this in advance and advised him. I guess they really think they will be the winners over this. Crazy. Maybe they are operating on the thought that any publicity is good publicity.
I don't guess this has any short-term negatives for Huckabee. He's trying to get the Republican nomination and his Republican "base" will like this move just fine.

As they say on the DailyKos:
IOKIYAR
which means, It's OK if you're a Republican.
Like King George, Prince Huckabee can do what he wants because he's a Republican. That seems to be the mantra of Republicans these days. The sad thing is that they get away with it or we wouldn't be in the many horrible positions that we're in today.
Despite what you've been told, conservative readers, Republicans have no one to blame but themselves for the problems our nation faces today. You can't blame everything on Democrats when Democrats have the smallest amount of control they could possibly have.
A change is needed.

I keep publicly begging our leaders, mostly meaning Lincoln and Pryor, but hell....at this point, anyone...to let me in on the plan. You know the plan to remove crooked Republicans from office and punish them for their misdeeds. And I get nothing.
I keep waiting for one of them or someone to slip me the secret plan on civil disobedience, the how to do it, the place to meet, the do's and don'ts. And I get nothing.
I keep waiting on the plan for peaceful public protest, loud...strong and often. And I get nothing.
Our 2 Senators said Rummy is just alright with them yesterday. They decided Alito was a pretty good guy. They didn't raise a stink when the news got out that our government was in the torture business. They didn't support Russ Feingold in his effort to censure Bush. They didn't squawk much about wire tapping Americans. The let Gonzales lie and dodge and weave and apparently that's OK with them. They are just fine with Sen. Pat Roberts doing nothing about the investigation into the lies that have cost 2393 US soldiers their lives in a war for oil and Halliburton. One of them made sure Bush got 98% of his appointments past the Senate. By jove, good show I say!
Jesus H. Christ! We're a ship without a captain, we're adrift, we're lost, we're dying and all Lincoln and Pryor can do is send out happy form letters and shrug their shoulders when asked about Secretary of Defense Donald Custer and his record of 100% failure leading the war for oil. We've got nothing in Washington, DC but seat warmers. Woe unto us.
Posted by: Deathbyinches | April 27, 2006 11:14 PM
DBI, I am with you, brother, but e-mails get you nothing. Call them, repeatedly. Write real letters, repeatedly. And most importantly, when they appear in public, show up and ask the tough questions.
We must take action!

Max has been very naughty
As you have probably heard by now, the office of Governor Mike Huckabee has cut off Arkansas Times from its' list of working press to receive releases, schedules, and notices of interview availabilities. It may seem like a small thing, and seems indicative of the Governor's frequent pouty responses to legitimate criticism.
This has gotten a lot of discussion on the Arkansas Times blog.
This decision is more dangerous than may be immediately apparent, and let me explain.
There is a disturbing tendency among Soviet tyrants, Red Chinese dictators, European socialist elites, and other enemies of freedom to license and, thereby, control the free flow of information. By making an arbitrary and unnecessary judgment that a certain publication does not fit into some obviously elastic definition of "news organization," government attempts to exclude those with opinions which are inconvenient to the ruling party.
Journalism is, rightly, not a profession in the sense that medicine, law and accounting are practiced. We do not require specific academic credentials, we do not test our own members, nor are journalists subject to peer review. Any of this would be entirely subjective and the result would be nothing but a non-stop dog fight.
The freelance journalist, a category into which I fall, should have as much right to official timely information as the corporate giants.
It is a dangerous practice, and entirely against the notion of press freedom or free speech, for government to decide who shall get information. In other parts of the world, this technique is routinely used to silence press opposition. That means that the public only ever hears a certain "safe" and narrow perspective.
The founders,in their vast wisdom, left policing the press to the sovereign people and not the temporary office holders.

What an incredibly odious piece of hypocrisy you are, Mr. Lynch! You have enjoyed limiting free expression of ideas throughout your pitiful radio career while basking in your all-too-frequent episodes of belittling callers and critics. Yesterday you deleted the following comment I posted on your blog ....a blog that only rarely includes any comments except those generated by your own pathetic bloviations and pompous ignorance:
Patrick,
Kudos to you for your right-on rant about the greed of Blue Cross / Blue Shield. Most corporations in our beloved former republic are, of course, equally guilty. The shame is that someday you will be forced to present ads other than those featuring " passing gas " and the American Taikwondo Assn., but I repeat myself. Hopefully you'll be as courageous when you can no longer depend upon charity, PSAs, and the rare " real commercial "! Roy

Someone once issued a warning related to freedom of expression of which you might also benefit being reminded:
There is a disturbing tendency among Soviet tyrants, Red Chinese dictators, European socialist elites, and other enemies of freedom to license and, thereby, control the free flow of information. Is it not time for Mr. Lynch to choose "the free flow of information" over his own petulance and " frequent pouty responses to legitimate criticism"? The Pine Bluff Commercial is a Stephens paper, but it could hardly be called liberal. Somewhat more to the center than the D-G. At least, there isn't the rantings of Mike "Comstock" Masterson, Bradley Gitz, and the like.

Give 'em hell, Max...the Guv needs some new advisers, expecially if he is serious about a presidential bid. Jackass has is right...why alienate anyone when you should be trying to get your message out to as many people as possible...then again, he plays bass in a band but doesn't dance...what a mullett...
Posted by: rosso | April 28, 2006 10:48 AM
James, the guv certainly gets to show a bit of favortism by virtue of his office. For instance, if there are only six seats for the press at the conference table, he can make Max stand up in the back. If there are only X number of press parking spots at the Capitol, he can deny one to the Times. He can pick which media outlet he wants to give interviews to and deny his critics -- kinda petty, but he's the guv and he can do it.
But we are talking e-mail distribution of press releases, schedules, etc. How much does it cost to add Max to the e-mail list? NOTHING. And even if there are some costs -- and there may very well be -- if the Times or any other media outlet makes a reasonable request, it's in the best interest of the public to grant it.
The Times is a bit liberal for my tastes. But they have good, smart, respected writers and I like to read what they say whether I agree with it or not.
The guv acted in a petty, knee-jerk manner. There is no defense of it. Republicans seem to have thin skins at times.
