The governor's office goes silent

It's official. Gov. Mike Huckabee is refusing to provide routine media services to the Arkansas Times. The newspaper has been stricken from the e-mail lists for routine news releases, public scheduling and other items widely disseminated to members of the public and the media.

Press spokeswoman Alice Stewart gave us this statement:

We don’t consider the Arkansas Times a news organization. By your own definition, you are a journal of politics and culture. As you said, there are hundreds of news outlets in the state and we don’t attempt to notify every one of them. The major news organizations are on our e-mail list and that’s the way it will continue.

She declined to answer all further questions -- when the decision was made, why it was made, by whom it was made. "That's the statement this office is offering," she said.

 

The Times is, of course, a news medium. We report news on this blog and in our weekly print edition on a regular basis. But definitions are largely irrelevant. The Freedom of Information Act is the public's law, not a press law. Rights abridged under the law for one are rights abridged for all.

 

We believe we are entitled to access to all press documents issued by the governor's office by virtue of the FOI law. A "working papers" exception cannot be claimed on information if it is otherwise being provided to others.

 

But this is of course primarily a First Amendment issue. The governor has decided to punish us for our opinions by withholding a publicly financed service. We don't think this practice can stand legal scrutiny and we intend to review our options in that regard.

 

Will other members of the press stand with us on this issue? Or will they fear retribution?

Don't feel special. Quite a few weeklies aren't on the list.

If you really care do things the American way. Go file daily FOI requests on that crap and annoy them into submission.

You aren't paying for those press releases with your money. They are being paid for by me and others who don't always agree with you but realize that the public has the right to know how the government is working, even actions that we disagree with.

We published a monthly newletter in our town for six years which listed town business and everyone, even those who didn't like the fact that they might have their minutes of their meetings published, sometimes to the amazement of those who voted for them, agreed that a written request to be notified of meeting, provided with the planned agenda, and the availability of memos ,etc is the law in this state.

Seems like this kind of petty thing wouldn't be practiced by a man hoping to run for national office.

But petty is a Huckabee standard. I recall that the Times has routinely been excluded from other things, including some nice meals.

Good luck in your pursuit of legal remedies. I hope you embarrass them no end. Like so many cases of this kind of action, they will end up realizing they should have left well enough alone.

My uncle got a call from Sara Agee in the governor's office last week. She was trying to raise money for Chris Morris. Isn't that illegal? No wonder they are hiding from the media.

I don't know that you'd win on a First Amendment claim (re the freeze out of reporters in Maryland), but the discovery process would be worth the price of admission. You could sell tickets and broadcast rights to Huckabee sweating under the glare of inquiry under oath. And you could have a contest for who gets to deliver the subpoena for the distribution list and notes of internal discussions, emails, the smoking gun memo, etc.

Huckabee, like his presidential counterpart, has shown nothing but disdain for the press (and the accompanying 'rights') since he was elected governor. I guess self-professed men of God don't answer to trivial concepts like the press as a watchdog rather than an enabler.

Even if you hate the Times (or the media in general), a governor's office that self-determines what media are worthy of their acknowledgement should concern you.

The AT should take some action here simply out of principle. On the other hand, it won't be long before Huck is a paid lobbyist or back in preaching. My bet is if he actually does make a run for president, it will be so embarrassing that he won't be able to run for public office again. This confirms what I've said all along about the Gov (and I've been reluctantly voting for him too). He's a political lightweight. He can't handle a little ole weekly liberal leaning rag who gets under his increasingly thin skin. No way this guy could run for or hold a national office. He'd have a meltdown within a week. Some of you are saying freedom of the press, well that is ridiculous. the Gov. is not telling the press what they can write so it is not freedom of the press or free speech or any of the first amendments. That is a losing battle in this case. The other claim is FOI,FOI, FOI. It is starting to sound like "Citizens Arrest" around here. As to the folks who say the Gov. denies access to the media, c'mon. One day you claim he is always calling a press conference, or doing a talk show (where the people not the press ask questions), or getting on the radio or something, and the next you are saying he is dodging the press, because he told the Times they aren't going to send them a press release. Maybe the Gov.'s office figured since you will work so hard to write a story that doesn't exist, you would have no problem writing one that does. So no need to bother sending you one.

ARK. BLOG 1) a public player cannot punish someone (by withholding public services) on account of unpopular opinion. That's a first amendment issue. 2) ANYBODY who requests public information is entitled to it. The FOI is the public's law, not a press law.

I tried to send a critical email to the Gov's office and it was rejected due to some server error. Guess if ti is not complimentary the server sends it back. This is just another example of his pettiness. What will he do with the New York Times when he hits the big time trail?

Yes, thank God for the Arkansas Times. Without it I wouldn't know where to go for the best 'cue, as they call it, although I never heard barbecue shortened to that precious syllable in all my Southern days before their usage.

You know except for when Huckabee is being a gift whore, or when he flip flops when one of his owners jerks his chain, there really is no need to waste newsprint or pixels even mentioning the fool.

He accomplishes so little for the state of Arkansas, we could go years without hearing or reading his name. If it wasn't for his outsized ego, he'd still be in South Arkansas passing out snakes to his little congregation every Sunday. Watching Rome on HBO 6 months ago was every bit like watching modern politicians. They really do set up little kingdoms of their own right in front of our eyes. Huck has built himself a new mansion to live in, got free clothes from Jennings, got new furniture from another guy, got a free airplane to fly around in, got some 3650.00 cowboy boots to walk in, 500 buck belt, free cars, trips all over the country for his personal benefit...He's a little King George Bush, party of 1, the Hope Sun God......and we pay for it one way or another.

And now as Huckabee heads down the homestretch to unemployment, he's getting grumpy. He has removed his pail and shovel from the sand box and he doesn't want to play with the Arkansas Times any more. Think of it more like losing a scab, Max and Warwick. It's actually an honor to be cast out of Huckster's fan club. It's like not being invited to Paula Jones next birthday. I don't get into politics because I'm too much of a snob, I would rather take an acid bath than even be in the same building with most of our politicians. Since the AT is part of the Stephens family, aren't your other "partners" getting these releases? This isn't any abrdigement of the rights of a free press or a violation of FOI, it's a pissing contest between the Guv & AT. Sorry, but the Guv will win this one because while it may not be convenient for AT, it's not in the same ballpark (or even the same sport) as being illegal. If the Times wants access to the news releases, it should have it. It's not like it's costing the state anything to add Max to the e-mail list. It's merely an attempt to discredit the Times. Huck has every right (and it's called freedom of speech) to criticize the Times if he wants. But he shouldn't turn it into a state action by excluding them from press releases that other media (many competitors to the Times) are receiving just because he doesn't like them. That's petty and violates the spirit, and most likely the text, of the First Amendment.

I think you know very well that you don't have a case against him on this one, considering that the press releases are on the website and the information is being distributed. If you want it you are going to have to look it up online or get it from one of your friends. He is not telling you that you can't print stuff about him and therefore not a violation of free speech and you know this too. You use the phrases because they are bad and get folks in the spirit of anger. However, if you thought you really had him, this would have already been filed in court or with the ethics folks. The fact is that the press releases are not posted on the website in a timely fashion. Those who receive the emails get the news first.

Huckabee is a public official using public resources. He can't discriminate and give favorable treatment to some organizations and not others.

We have agreements as "content partners," which means mainly that we are allowed to post headlines from their Capitol bureau on our website and they provide a link to our website on their website.

The word "arrogant" comes to mind, as it has many times regarding our chief executive at the national level... I can't understand how these people get into office....

You are not a reliable news source publishing opinions and rumors , gossip, ect. Not long ago the Editor called a legislator to find out if a rumor being spread around the Capitol was true so he could do a huge spread on the story. He threatened to call the Capitol Police to see if he could get a "police report" allegedly documenting the rumor. There was no police report and the rumor was not true- how pitiful is that!......Grow some balls and report on policies and laws being passed and hire some damn good journalists with intelligence enough to stay away from the petty stuff.

It isn't so hard to get the briefing. Just do it back channel through a group of concerned citizens who sign up and mail it to you, and get more than one e-mail sender to send it to you, thus avoiding any claim of "making things up."
