Huckagoguing

The only surprise is that it took the governor a full 24 hours to join the gay-bashing chorus on the Supreme Court ruling on foster parents yesterday. But he clearly got his quote from the same talking point factory other Republicans have used. The chant is that  the court had placed the interests of gay people ahead of children.

Read the opinion, governor, A$a, Jim, Gunner, et. al.. It was precisely because the state failed to consider children first that the rule was struck down. And the little matter of separation of powers.

The good news is that -- while Huckabee can talk all he wants about what the legislature should do in January -- he won't be around to help.

He's having reporters in to the Mansion at 3 p.m. today to talk about his Asian trip. Drop by if you have anything you'd like to ask him.

This is no brainer material for those who deal in family law. Case after case after case always states the Arkansas Supreme Court policy: the needs of the child or children come first.

And how many homeless children have Huck and Jethrine opened their (public funded) home to?

How many foster children does A$a have? Gunnar? Holt? How many?? Reporters: Ask them and print their responses.

Children in need don't give a fliying flip about whether a foster father or mother is gay or straight. They just want a home.

I am sick and tired of these sanctimonious religious righters pushing their white-bread, Republican, rich suburban, Baptist fairytale uptight world view on the rest of us.

If a brave, generous gay couple has the heart to open their home to a kid in need, they deserve a medal and the gratitude of the rest of us.

American Civil Liberties Union in Arkansas, said the court ruling itself could make legislation difficult to pass. She cited language in the ruling that said there was no connection between homosexuality and a child's welfare."

Difficult to pass? Hardly. It sailed through the House last year and will again. This just shows that the ACLU types do not understand the legislative process if they think evidence to the contrary will negate a legislative finding of "fact" or that a majority of legislators would pass up a chance to vote for a gay-bashing bill.

It is amusing to see The Huckster gay-bashing, given how he's never hesitated to "bottom" for his sugar daddies.

The DPA should stand up for what is right on this issue. I won't hold my breath. Jason probably agrees with the Republicans on this.

I wish all the gay people who are staffers, friends, or family with these Republican Neanderthals would give each one of them a tap on the cheek. They would be smitten by sunset.
They have no idea how many of their closeted staffers, friends and supporters are gay. But who in their right mind would "come out" to cut throat political hacks like these guys.

Real men would not hide on this issue. Sexuality should not be a factor. If you want to say no to all singles then fine. The state makes a lot of money off the feds for keeping these kids themselves. They don't want to find homes for all of them.

When violence is directed at homosexuals the world knows about it from the media. When this sick act committed by homosexuals was done it was given far less attention by the media. Why is that?

Do you honestly think that every act of violence against a homosexual garners massive media attention? Do you honestly believe that Matthew Sheperd was one of only a very few homosexuals to have violent acts perpetrated against them? Look, who knows why the media chooses to go on and on about the Natalie Holloways or the Laci Petersons, while completely ignoring the countless other murders? And the truth is that there was quite a bit of media attention to the case you speak of, especially within the state. But what, may I ask, does the amount of media attention given to acts of violence by or against a homosexual have to do with whether children can be given a good and loving home from a gay person?

Give me a break, sweetheart. The press loves stuff like that. They refrained from a specific crime because and only because it was perpetrated by homosexuals. If you don't believe that you must be incredibly naive.

When we put children with someone we are putting a stamp of approval on those people as being acceptable parents. There is nothing acceptable about homosexuality. It is not acceptable for parenting and it is not acceptable as a life style that the culture or the state should endorse.

Posts like 3:14 and 3:16 are mindboggling to me.

The political purpose of the homosexual community?

Here's a little newsflash for you, sis: homosexuals are in YOUR community. I guarantee you that you interact with (and even like) some homosexuals. You just don't know they're gay.

Doctors, lawyers, cops, firefighters, nurses, bank tellers, social workers, laborers, Wal*Mart associates, veterinarians, insurance agents, convenience store clerks, preachers, teachers, reporters, waiters, stock brokers. Oh yeah, and soldiers.

That's the homosexual community.

some more thoughts on gay foster parent opinion

1. have any ark politicians come out in support of the opinion? Of course Huckabee appointed Betty Dicky sided with the ACLU on this case, as did Huckabee appointee special judge Poff

2. Mr. Poff is a huge trial lawyer. Interesting choice for Huckabee I'd say. I'm curious how much Poff has donated to the Huckster

3. This opinion has no effect on whether two unmarried persons can be foster parents, whether they are gay or strait. If you are an unmarried couple living together- you can't be foster parent unless you get a waiver - and apparently they don't give waivers for that

4. This opinion has very little effect on what would happen to a law, as opposed to an administrative regulation, would be viewed in the ark sup ct. To bore you with some legalities -- an administrative regulation has to be rationally related to a legitimate governmental interest. They had a trial with evidence to show there was no rational relation - no credible expert testified as to any harm form having gay parents or gay foster parents.

A law ( or initiated act I assume) is viewed very differently by the court. A law must still, at a minimum have a rational basis - but unlike in this most recent case where DHS ( as ordered by the Huckster) had to attempt to prove through lengthy trial that there was a scientific basis to its rule, the legislature is not required to articulate its reasons for enacting a statute, it is entirely irrelevant for constitutional purposes whether the conceived reason ... actually motivated the legislature... In other words, a legislative choice is not subject to courtroom fact-finding and may be based on rational speculation unsupported by evidence or empirical data. If a law is passed - then to have it overturned using the rational basis level of scrutiny - all the Court has to find is that there is some conceivable, plausible basis for the legislature's actions. Personally, I don't think the state could even show that -- but its an entirely different question and analysis.

Where a law infringes on people because of age, race, national origin, etc., then even a higher level of scrutiny is applied. ( the legal lingo is "suspect class" and there is intermediate scrutiny, but lets skip that) I don't think any court has ever found that homosexuals are a suspect class - but I could be wrong. I don't think they are - but I still think they should not be discriminated against, and one day there might be statutes enacted to outlaw discrimination on the basis of sexual orientation.

My point, and I do have one, is that I don't think the ACLU could win on any equal protection grounds, not that it wouldn't be a noble effort.

Listen up y'all please to a post made earlier by me. Consider something much more than sexual preference and your feelings of justice towards that. There is a much greater justice than that for now. The GOPers must be stripped of power in every way, in any way, at every level. It is much broader than a right that can wait. Rights have waited in the past, reluctantly, but in the end those postponed rights bowed and scraped to the original rights on a rock solid piece of paper that never succeeded to fail..........

Here is a take on a popular liberal cliche: I support the homosexuals, I just don't support their acts of peversion.

I support all people, just not their acts of bigotry, discrimination, and hatred.

The court's unanimous decision means that one of Huckabee's own case-specific special court appointees, Judge Mike Poff, ruled that there is no reason to ban gay people from fostering. That would tell a more intelligent governor something.

Oops! The Huckabee appointed judge was Frank Poff, not Mike.

How many on this can remember at what age they made the choice to be straight or gay? I have no memory of that momentous event during my childhood. I grew up in a state that was segregated based on race, marriage was only legal when you were of the same race and it did not matter if you "passed" for one race or the other, you had to prove it via your "bloodline." It was legal to discriminate in employment, housing, as well as maintain a poll tax.

I was required to attend church services Sunday morning and evening and on Wednesday evening and heard from the pulpit wherein the bible was quoted from and used to justify this form of racial discrimination and even violence in certain circumstances. It was the duty of the white men to protect marriage and the white women from the ###men and the NAACP.

The state that I grew up in and is still my home? Arkansas! Why are those who are posting words of hate and bigotry not also putting their names to their words? I believe it is fear, the same fear that feeds their bias to those who are different.

GLBT people in this state are a minority but not when one counts, parents, grandparents, siblings, childen, cousins, neighbors, friends, etc. This is a growing majority and woe to the politicans who lack the courage to take a pro stand on civil rights, especially for the rights of children, especially glbt children. History will remember these politicans just as it has the George Wallaces and Orval Faubus'.
