Wooldridge opens fire -- UPDATE

Is Tim Wooldridge behind? Our guess would be yes. He's gone nuclear on opponent Bill Halter's business record. Some of it his people have been salting on the blog previously. Now he's stepping behind it himself. All the griisly details in full news releases on the jump.

Wooldridge Questions Halter’s Real Experience

May 26, 2006 – (Little Rock, AR)  - Senator Tim Wooldridge of Paragould, Democratic candidate for Lt. Governor, said today that Arkansans should have some real questions about Bill Halter’s professional associations and experience.

“Bill Halter raised this issue on his latest television ad,” Wooldridge said.  “He makes the statement that he would ‘…take my experience leading five high-tech companies and use it to improve our schools..’.  The question I have for Mr. Halter, is exactly which experience he is referring to?

“Is it the experience of losing hundreds of millions of dollars?  Is it the experience of  being forced to pay restitution to small investors who were cheated?  Is it how to deal with a federal justice department investigation? 

“Perhaps it’s the experience of profiting from online gambling and internet pornography,” Wooldridge said.  “Does he actually want to teach our children that it’s alright to profit from those types of industries, even using those ill-gotten gains to seek public office?  Maybe he sees little wrong with those issues, since one of the companies he ‘leads’ was found to be storing images from teen pornography and gambling sites on public school and university servers,”  Woodridge said.

Gary Moody, Wooldridge’s campaign manager, said “The only thing most Arkansans know about Bill Halter is what he’s told them in his television advertising.  He moved back to Arkansas last fall after being gone for over 20 years, expecting to be welcomed with open arms in a race against Mike Beebe for Governor.  When that didn’t happen, he jumped into this race and began painting a picture of himself that is less than complete,” Moody said.  “He wants to tout himself as a business ‘whiz kid’, but in reality, he has made himself wealthy while his companies are losing hundreds of millions of dollars.  Those are the facts.”

When it comes to actually improving the quality of life in Arkansas, Wooldridge says there is little comparison between his performance and Halter’s promises.  “He likes to talk about how his influence in business will help Arkansas land new jobs.  But if he’s so influential and cares so much about Arkansas, why hasn’t one single job been created here by one of his companies?” Wooldridge asked.  “I have been either the lead or co-sponsor of the Consolidated Incentives packages the past two sessions in the General Assembly.  This legislation is helping create over 11,000 new jobs, and is responsible for almost $2.8 billion in investment back into our economy. 

“I have served the people of Arkansas for almost two decades in the House and Senate, casting over 15,000 votes during my tenure.  My service is an open book, and I’m proud of what I’ve accomplished.  If Bill Halter wants to ask Arkansans to give him the privilege of serving as Lt. Governor, then he should be more open and honest about his experience.”

Background:

Mr. Halter’s current television advertising campaign features the following statement: “As Lt. Governor, I’ll take my experience leading five high-tech companies and use it to improve our schools…” – Bill Halter.

 

Bill Halter currently serves on the board of four companies: Akamai Technology, WebMethods, Threshold Pharmaceuticals, and Xenogen. Late last month, he resigned from the board of Intermune Corporation amid SEC and Federal Justice Department investigations into the companies marketing practices.

 

With the exception of Akamai, Halter’s business ventures have been financial disasters. During the time that Bill Halter has served on their Boards of Directors these companies have lost the following sums:  1. InterMune lost $290,465,000 

                                                 2. Threshold Pharmaceuticals lost $52,818,000

                                                 3. webMethods lost $32,806,000

                                                 4. Xenogen lost $128,931,000   (www.nasdaq.com)

                                                Grand Total lost: $505,020,000 (over half-a-Billion dollars)

 

The one profitable company Halter has been involved with is Akamai, who has some business practices that are cause for concern, including business relations with the gambling and pornography industries. Background information on it and the other companies Halter has been involved with is detailed below:

 

Akamai Technologies:

Bill Halter joined the Akamai Technologies Board of Directors in August 2001.  He has been a member of the Compensation Committee since March 2004.  (Akamai Technologies, SEC Form DEF 14A, 04/11/05)

 

Akamai Technologies “enables companies and government agencies to deliver Web content and applications (including ads, video, and other high-bandwidth content). 

 

Cheating Small Investors - Akamai Technologies went public in 1999, at the height of the Internet bubble, and latter was forced to pay as much as $1 billion as a result of a legal settlement on charges that they cheated small investors.  The agreement, which was reached in June 2003, stipulated that the issuing companies, including Akamai Technologies, would pay nothing if an eventual payout from banks exceeds $1 billion.  “In the unlikely event the banks’ payout falls below $1 billion, the companies would have to make up the difference.”  (USA TODAY, 06/27/03)

 

Gambling and Porn - Akamai Technologies has long-term business relationships with purveyors of teenage pornography and Internet-based offshore gambling operations.  It was “using university networks to help deliver content for Web sites featuring teen pornography and potentially illegal offshore gambling.”  In December 2002, “Akamai Technologies…apparently began to stop using server computers it…installed at universities and colleges to help deliver Web content from teenage porn and offshore gambling sites.”  In 2002, company spokesman Jeff Young “would not comment on specific servers but reiterated…that Akamai is phasing out its relationships with three gambling sites and with porn sites, both of which he said represent less than 1 percent of Akamai’s annual revenue of more than $100 million.”  (Knight Ridder Tribune Business News, 12/07/02, and National Journal’s Technology Daily, 12/04/02)

InterMune:

Bill Halter joined the InterMune Board of Directors in July 2002.  He is a member of the Compensation Committee, and has been from July 2002 until his recent resignation.  (InterMune, SEC Form DEF 14A, 04/20/05)

 

InterMune is a pharmaceutical “company focused on developing and commercializing innovative therapies in hepatology and pulmonology.”  (www.intermune.com)

 

Federal Investigation - The U.S. Justice Department, in 2004, opened an investigation into the marketing of Actimmune by InterMune.  “Actimmune, which has generated hundreds of millions of dollars in sales, is approved only for treatment of two extremely rare childhood diseases.  Yet ‘substantially all’ of the sales are for a fatal adult lung disease, idiopathic pulmonary fibrosis, according to the company’s…regulatory...” filings. 

 

 “Several former InterMune employees said in interviews…that the company actively promoted off-label use of Actimmune, which costs patients about $50,000 a year.  Sales representatives were told to repeatedly call on lung doctors but to record their visits in the company’s computer system as relating to a different drug, they said.  And bonuses were paid to representatives based on Actimmune sales, virtually all of which were for the off-label use, they said.

 

One former sales representative, Joan Gallagher, sued the company in March [2004], saying it had fired her for refusing to go along with what she said were illegal marketing practices.  InterMune…denied the allegations in the lawsuit.”  (The New York Times, 11/11/04)

 

Multi-million class action lawsuit - InterMune, in May 2005, also “agreed to hand over $10.4 million to shareholders to settle a 2 year-old class-action lawsuit.

 

The litigation…charged the company and two former executives with securities fraud.  Plaintiffs alleged that InterMune and its past CEO and chief financial officer had falsely projected sales forecasts two years ago for one of its products, Actimmune (interferon gamma-1b).” 

 

“When the Brisbane, Calif.-based company revised its guidance downward, and admitted that it had overstated the number of patients using the drug, its stock lost a third of its value in a single trading day.”

Threshold Pharmaceuticals

Bill Halter joined the Threshold Pharmaceuticals Board of Directors in October 2004.  (Threshold Pharmaceuticals, Prospectus, 02/03/05)

 

Threshold Pharmaceuticals is a pharmaceutical company that is focused “on discovering and developing therapeutics based on its Metabolic Targeting system.  (www.hoovers.com)

 

webMethods:

Bill Halter joined the webMethods Board of Directors in August 2003.  He is a member of the Compensation Committee, and has been since August 2003.  (webMethods, SEC Form DEF 14A, 07/22/05)

 

Cheating Small Investors webMethods went public in February 2000.  It was involved in the same legal settlement as Akamai that was discussed above for cheating small investors.”  (USA TODAY, 06/27/03, and www.webmethods.com)

 

Enron Accounting - webMethods, in February 2005, restated “its 2004 financial results by about $5 million because of improper transactions and accounting activities.”  According to the company, employees of a “subsidiary, WebMethods K.K., conducted improper licensing transactions, did not record certain expenses, borrowed money without authorization and misled webMethods managers about the unit’s financial results.  The Securities and Exchange Commission…launched an informal investigation into the matter, the company said.”  (The Washington Post, 02/04/05)

 

Xenogen:

Bill Halter, in April 2002, joined the Xenogen Board of Directors, which is a biotechnology company “whose medical imaging technology is used by Bayer, Pfizer and Chiron to help discover and develop drugs.”  (Alameda Times-Star, 04/03/04)

 

Since Xenogen went public in July 2004, the stock price has plummeted from $8 per share to approximately $3 per share.

 

HALTER NEWS RELEASE

On the day after the NAACP questioned Tim Wooldridge’s advocacy for public hangings on county courthouse lawns across Arkansas, Tim Wooldridge reaches for negative campaigning in a desperate attempt to change the subject.

 

Wooldridge’s charges are reckless and false.

I have to agree with the point made that if you source facts in regard to a public figure seeking political office, and such facts are credible, you cannot describe it as being negative. An informed electorate has the right to know about their elected officials. Mr. Halter is well schooled in Clinton politics, so expect a rapid response on the issues brought forward by the Wooldridge campaign.

Schools benefited from the relationship because they gained faster Internet access and paid less money for more bandwidth. At first Akamai downplayed the controversy, maintaining that pornography and gambling represented less than 1 percent of its revenues and that it was not going to renew contracts with online gaming companies and no longer sought new business from what a spokesperson referred to as "adult content sites." Within a couple days the Boston Globe reported that the objectionable material was no longer mirrored on the college servers it checked.

I voted for Woolridge in the primary. I really voted for him as a vote cast against Halter.

Now that I have seen the crap that Woolridges camp is coming up with, I will now push my support to Halter.

This is the same reason I decided to vote for Suskie over McDaniel in the AG race. McDaniel made some negative comments to me about Suskie's 6 year old son, which turned me off on him.

I guess it is just more of the crap from the NE Arkansas mofia.

I did not vote for Senator Wooldridge in the primary, because I disagree with his record and positions on TIFs, Deltic Timber, women's rights, and economic development issues in general.

Until today, however, I thought he was a decent felow and had run an admirable campaign to make the runoff. I am disappointed in what he has done to himself and to the Democratic Party of Arkansas.

The party will recover after the run-off, but I think that Wooldridge, if remembered at all, will be remembered for a desparate campaign beneath the dignity of what Democrats deserve from those seeking statewide office.

Surely you people dont think this information came from the Hathorn campaign? If hathorn had had access to this, he would have used it in a heartbeat. And dont go thinking the broke Wooldridge campaign has a way to compile this information.
This stuff came from the Beebe campaign. They compled it before Halter switched races. Beebe has given it to Wooldridge since he did not need it. This makes it crystal clear who the General wants as his running mate.

I seem to remember one of the Wooldridge AT Blog patrollers accusing me of making shit up. Boy, do I feel like a rank armature. It seems to me that often the battle cry "Protect the children" is really expressing the ideal "Protect everyone from what society says i should be afraid of". Most issues that revolve around censorship deal with taboos that simply don't make sense anymore. A taboo about sex made sense when sex directly lead to pregnancy. With education, it doesn't anymore. Rather than hiding, perhaps we should educate. Not everyone will make the right choice, but that is their right. To choose.

Akamai rents out a network of 12,600 servers that help customer Web sites deal with unexpected traffic, hacker attacks and Internet bottlenecks.

In a prepared statement, Akamai said it "worked briefly this week with Al-Jazeera to understand the issues they are having distributing their Web sites," but decided not to continue the relationship.

Akamai would not comment Friday on why it broke off the collaboration.

"We think it's political pressure," said Nabil Hegazi, deputy managing editor of Al-Jazeera's English-language Web site.

While Aljazeera worked to alleviate these problems, many of their Western partners dropped out of the venture - some claim due to political pressure from the U.S. government and some American citizens. DataPipe gave notice as the Web site's host. Later, U.S.- based Akamai Technologies (www.akamai.com), a company that claims its serves can stand up to unprecedented traffic, signed on to host the English site - but promptly pulled out of the deal for unspecified reasons.

All accusations aside, this race should boil down to one thing: Who is best for the State of Arkansas.

On the one hand, we have a candidate (Halter) who left the state many years ago only to return to run for a constitutional office. We really know nothing about him. While I don't care one way or the other on a lottery, here comes this guy that hasn't been here in forever and wants to run on the platform of pushing a lottery. He has no knowledge of the state's budget, the legislature (except what he might have learned many years ago in Civics class) and, in short is unfamiliar with the wants, needs and demands of the Arkansas people.

On the other hand, we have a candidate (Wooldridge) who is intimately familiar with the workings of our government. Sure, I differ in many ways with him on political philosophy (I'm a liberal and he is a staunch conservative) but at least I know him and what he stands for. I can look at his voting record and learn something of him (yes, the hanging bill was a little off the path, but remember, he filed it at the request of a constituent who wanted only to get a debate going on the loss of the deterrent effect of the death penalty due to delays by multiple appeals). He has lived here, worked here, raised a family here and governed here.

Being a liberal, I still wouldn't vote to elect an unknown liberal over a conservative that I know. I can deal with what I know. It's what I don't know that is hard to deal with.

I've actually worked for both of these campaigns for a short term, but in the end I'm sadly disappointed in both candidates. I think the second question is very relevant and fair. If a person claims to be a Democrat, then shouldn't they vote for Democrats? A true Democrat would NEVER vote for George W. Bush. If I were in this LG runoff, I'd spend all 100% of my time trying to get my supporters to the polls. Either of them had enough votes in the primary to win the runoff if each of those same voters would get back out. It will just depend who focuses on what the real task is. The one issue in a runoff is nothing but TURNOUT.

It's interesting that so many people went into the voting booth with Wooldridge to see how he voted. The first time I was allowed to vote, I voted for Richard Nixon. I haven't voted for a Republican since. But, I had to hold my nose to vote for John Kerry - in my opinion, one of the worst Democratic nominees in my 30+ years of following politics. Bush is turning out to be the worst president of my lifetime, barely edging out Jimmy Carter. Against Kerry, while I wish he had won and we would be better off if he did, I won't hold anyone accountable for either not voting or voting the other way.

I just saw the Halter attack ad against Wooldridge. I guess that he is willing to attack unlike what he said when he exited the Governor?s race.

Not that I am saying I believe any of the companies that Halter is connected with is involved with pornography, I'd just like to point out that many old line US companies derive part of their profits from pornography.

General Motors and AT&T, and Hilton Hotels just to name three are own companies that deliver porn content to certain markets. Are you Bible thumpers going to quit driving Chevolets, using your telephone and staying in hotels and motels that have pay-per-view in-room movies?

The number of postings on this blog post vs. the number of postings on the election recount go along way toward defining what is wrong with this country, our elections and the state of the union in general.

Why? Because noone gives a tinker's damn if the votes count as long as they can 'go through' the motions and bash or support their candidate. Even Mike Huckabee said the election problems were 'unacceptable' and that he was surprised no one was kicking up more of a fuss about it.

I am sad that Mike didn't win, but in a way, I'm glad he didn't because his loss has shown his and his campaign employees' true character. They care more about their bitterness than about their democratic principles. They care more about their pride than about the state they are affecting by helping a person like Wooldridge win a public office. They care more about Bill Halter than they do Arkansas, and I find the irony in that statement hilarious.

What do I mean by that? They are so concerned with Halter, so incredibly pissed off at him, that they care more about beating him than they do about democrats and Arkansas. So if this was the underlying character of Hathorn and his people, well, I'm glad he didn't win. Time to grow up and quit being a cry baby.

Excellent column today by Meredith Oakley which shows that Wooldridge DID push the hanging bill back in '95. As Oakley points out, Tim's "memory is rather muddled."

Please note that no corrections or retractions related to those two stories ever ran. One can assume that this is because Wooldridge never sought any.
Having lived to tell the tale, I know something of the impetuosity of youth, but Wooldridge 's advocacy of the hanging bill can hardly be put down to that. He even said at the time that he ' d stewed over it for two years before introducing it. There ' s no doubt that he now wishes he ' d emptied that pot instead of dishing up its contents.
Wooldridge isn' t the first lawmaker to be worn down by a persistent constituent and he won ' t be the last, but in the final wash it was his decision to take up the legislation and run with it. All he needs to say now is that he was wrong, or just misguided, or that he has since changed his mind.
Just please spare us this talk about trying to elevate the discussion when the only thing that got elevated was one politician 's public profile.
