Again with the illegals

I'm not sure how I did this, but I screwed up. I got a news release from Gunner DeLay on immigrants. I thought I had posted it. When I went to add Dustin McDaniel's response, I realized I'd screwed up on the first part.

So, on the jump, first Gunner, then Dustin.

 

DELAY NEWS RELEASE

Fort Smith – Today in Fort Smith, Gunner DeLay, republican candidate for attorney general, set forth his plans of how he intends to use the office to deal with the problem of illegal immigration.  He also chastised his opponent, Dustin McDaniel,  for supporting a bill that would have given taxpayer funded scholarship money to illegal immigrants. 

 

“The people of Northwest Arkansas know, I have been one of the leaders on the issue of illegal immigration going back to my service in the Arkansas legislature.  In 1997, I sponsored House Resolution 1024 to study the financial impact of illegal immigration on state services.  In 2001 as a candidate for Congress, I was the first officeholder in the state to call for the use of the military to secure our national border.   As attorney general, I want to use the office to offer some common sense solutions to this critical issue.”   

 

“I need to point out that my record is in stark contrast to the record of my opponent who voted in favor of HB 1525 which would have given  taxpayer funded scholarship money to illegal aliens.  For someone that wants to be the chief law enforcement officer of the state, I can not understand why he wants to provide incentives for people to violate our federal  immigration law”, DeLay commented.   

 

DeLay  noted that if HB 1525 had passed into law it could have led to legal action against the state for violating 8 U.S.C. Sec. 1623 of the 1996 Immigration Reform Act signed by President Clinton.  That law provides that whatever benefits a state chooses to provide to illegal aliens it must also provide to U.S. citizens.  California passed a law similar to HB 1525 and now they are being sued in a class action lawsuit by non-resident students of their state universities because they were not provided the same opportunity to apply for taxpayer funded scholarship money.  “I hope Mr. McDaniel will explain to the voters what he was thinking when he cast his vote to undermine our immigration laws.”    

 

DeLay set forth three proposals that he intends to take action on in the next legislative session to address illegal immigration. 

 

First, he wants to hold employers who knowingly violate U.S. immigration law civilly liable for any public benefits utilized by their illegal employees.  This would include employers that either supply bogus documents, or bogus social security numbers, or do not ask for proper documentation at all when they hire someone.  DeLay explained that this can be done easily through the Medicaid Fraud Unit that is already a apart of the attorney general’s office.  “If an illegal employee has utilized medicaid benefits intended for our citizens, I believe I should be able to recover those monies from the employer responsible for creating that expense to the state, “ DeLay said.

 

DeLay’s second idea is to create a International Fugitive Database that can be accessed through the internet.  This database will include individuals that have committed a crime in Arkansas and escaped justice by fleeing across our border.  I intend to work as a liaison between the State Department and our neighbors to the north and south to make sure justice is provided to victims of crime.”

 

Finally, DeLay supports a law that will make it illegal for a bondman to provide bail to a criminal defendant if it is known that such person is an illegal alien and he is charged with a felony.   It seems to make sense that if someone is here illegally they are a serious flight risk.   Therefore we need to take action to make sure they are fully accounted for.”  

MCDANIEL NEWS RELEASE

LITTLE ROCK - Rep. Dustin McDaniel, Democratic candidate for Attorney General, laughed off criticism today by his opponent who said he has “undermined U.S. immigration law.”   

 

“Gunner is just trying to divert attention away from his ticket-mate, Asa Hutchinson, for his failures at the Department of Homeland Security when he was responsible for border security,” said Melissa Moody, McDaniel’s campaign manager.  While Hutchinson was at DHS, action against employers for hiring illegal immigrants dropped 99.3 percent.  "Delay is just trying to throw a rabbit across the trail so Arkansans don’t see how lax Republicans are with regard to illegal immigration,” Moody continued.

 

“My biggest concern with Gunner’s misguided proposal is the creation of an International Fugitive Database,” Rep. McDaniel said.  “There are already two databases that the Arkansas Attorney General’s office utilize that do exactly what Delay is proposing.   Frankly, Gunner should have known that.”
   

 

The databases Rep. McDaniel is referring to are The FBI National Crime Information Center (NCIC) and the database administered by the Arkansas Crime Information Center (ACIC).   NCIC is a computerized index of criminal justice information, including criminal record history and information on fugitives, and the data contained in NCIC is provided by the FBI, as well as federal, state, local and foreign criminal justice agencies.   Furthermore, the ACIC’s database interfaces with the FBI-NCIC, as well as similar databases in the 49 other states.

 

Rep. McDaniel has repeatedly spoken out against illegal immigration.
  During the 85th General Assembly, Rep McDaniel voted for Act 2267, establishing a Class A felony for trafficking of persons.  As Attorney General, Rep. McDaniel will push for strict enforcement of this law.  In addition, he has called for tougher penalties on employers who knowingly hire illegal immigrants and would support legislation to require all state entities and their contractors to utilize the Basic Pilot Employment Verification Program
to verify the employment eligibility of perspective new hires.  This is a free, on-line service offered by U.S. Citizenship and Immigration Services.

 

McDaniel believes that immigration is an adult issue.   The fact that Gunner is trying to punish innocent children puts himself with Jim Holt far to the right of Gov. Huckabee and even the republican party as a whole.

 

"Gunner's comments on the scholarship money are inflammatory and inaccurate.  Governor Huckabee, as part of his legislative package, proposed allowing a student who has lived in Arkansas for three years, and graduated with honors from an Arkansas high school, to apply for an Arkansas Challenge scholarship, regardless of where his or her parents are from.  On this issue, Gunner is outside of the mainstream of even his republican party nationally and in Arkansas,” McDaniel said.

Somebody please tell Dustin it is not about where you are from, but rather how you got here. You can't turn this into a race issue. To do that is wrong. Illegals should not recieve benefits that legals do not. How can you argue with that?

McDaniel's response sucks. Instead of dealing with the issue or commenting on his vote in the legislature, he brings Asa's record into it. What the hell? Dude, Asa isn't running for AG. Dustin and Melissa, get your shit together and stop sending out such stupid responses.

Dustin is missing the point, and I agree. I want Dustin to win, but with this type of myopia (sp?), I'm concerned that he is losing it. Dustin, Dustin, Dustin, look at what you have said, on the one hand, you bash Republicans, on the other hand, you join them and criticize Delay for not joining them. You cannot have it both ways. Please get your act together or you are going to give Gunner Dleay the AG's position without a doubt.


Gunner is not outside the mainstream and certainly not outside the mainstream of Republicans. Go check how many Republicans voted against HB 1525 despite their Governor putting enormous pressure on them.

Dustin will also have to answer for voting against allowing our state police to enforce our immigration laws.

Dustin Voted twice FOR granting the state police authority to enforce immigration laws. To say otherwise is another lie from Gunner's folks.

Of course, the state police neither wanted nor have they used that authority.

I remeber him voting against it on the floor and speaking against it. I don't know how he voted in committee but I am assuming the same way. He may have voted on concurring in a Senate Amendment or something but he was against the bill on its merits.

The state police did want it - that is why Col. Dozier testified for it and said that it would be a valuable tool. Look who is really lying (dusty) As soon as Asa is elected Governor, Col. Dozier will be freed up or forced to begin the program.

Who cares anyway, since Gunner isn't going to sniff 45 percent? Nobody is paying attention. Arkansas is already enthralled with Beebe's march to victory.

Through the primary and now in the general election Dustin continues to show what kind of dumbass he is.

OH MY WORD - I have heard it all now. First of all, Asa increased deportations by 47%. Did he solve the illegal alien problem - NO and he also did not solve world aids, hunger or prevent natural disasters. HE DID STOP ANY TERRORIST ATTACKS - which is something no one thought was possible on Sept 11, 2001.

This plan won't cost a dime you moron. The training is paid for by the feds and the state police simply enforce immigration laws as they encounter them in the course of their everyday law enforcement. Currently, they have to let go drug traffickers, child molesters, murderers and terrorist (See Florida and Alabama) In Alabama, their state police have tripled their revenues, not through taxes, but because of the increased drug assett forfeitures.

Asa designed this plan at DHS and now is coming back to make sure that AR takes advantage of it. Mike Beebe and Dustin are WRONG and will LOSE.

With all of Gunnar's strong feelings, he should be leading the charge to take some or all of that excess state tax monies and building prisons.

We could use the mediam between Little Rock and Memphis because no one could get across between all of those trucks.

If you expect the state p0olice to take on a federal responsibility, then you better figure either how many prisoners will be released or how many jail cells you are going to build. Or is this just another Republican sound bite like "border security' with a 93$ reduction in employer sanctions.

Hutchison was part of the Bush plan that did nothing for 5 years and now is holding all of these hearings to manipulate the issue. Like calling the Bush-McCain bill the Kennedy bill. You can make the pig's ear into a silk purse but it is still attached to the same pig.

This is an internal Republican issue and they are all going to pay at the next election no matter what their level in government is.

Yeah, Asa stopped terrorist attacks and the state police let murderers and child molesters go. Got it.

The state police only let them go because liberals won't give them the tools to stop them.

Col. Dozier wants this tool and testified for it. When Asa is elected, it will happen.

In regards to the jail space. This bill will ease jail space. Right now, we are holding these illegals on sometimes weak state charges in county jails or state prisons. This would allow us to put them in the federal system and let them pay for it.

This program has worked everywhere it has been tried and has even increased the state revenues. The only reason to oppose it is because you are for illegal immigration.

Currently, when a police officer pulls somebody over for a traffic stop they have 15 minutes (Terry stop) to either charge the suspect or release them. 15 minutes is not enough time to determine if they are a child molester, drug trafficker, or terrorist. So either they have to manufacture a weak state charge which could result in racial profiling and forces the state to pay for that person or the state police have to let them go, which is what the FL state police did with two of the 9-11 terrorist. This is a terrible predicament to put our police in.

Additionally, you need probable cause to open a trunk to seize drugs. It is almost impossible to get reasonable doubt unless the person has 5 kilos, or a tied up child in the back seat of the car. However, if a suspect does not have proper documentation, under Asa's plan, the police can detain them on immigration violations. This gives the police enough time to determine if they have just pulled over Muhammad Atta or a member of a Columbian Drug Cartel. Also, once they are detained, you can check their car and discover those 5 kilos, a little child, or a nuclear bomb.

If it is drugs, you seize the car and other assets and the state police keeps it. I didn't make up the numbers about tripling the asset forfeiture seizures. Alabama experienced that. This program works - we don't have to make up arguments - we have facts on our side.

It is hilarious that Dusty and Mike "tee it up" Beebe are going to debate Asa about illegal immigration and law enforcement.

By the way, Col Dozier is for the plan - It's the Governor who is holding him back.

Dusty, go back to your police manuals and study up a little bit before you blog again.

Anyway, why not just set up roadblocks and detain everyone until they have proved they are not a criminal? That is where you republicans are heading with your cradle-to-grave, email to telephone to bank records, surveillance of citizens.

You don't deserve to be free, because all you do with your freedom, and ours, is throw it away.

Ok, fair debate. You think that Asa's plan goes too far. I disagree but that is a legitimate argument.

What is not legitimate is claiming that this will cost more or burden the state police, or increase racial profiling. Those are red herrings and intentional distortions.

It certainly is a HUGE tool for law enforcement and will result in many more arrests based on detaining them because they are illegal aliens.
Your concerns, crazy professor, are not crazy at all. I, personally, don't have a problem with the program but I can understand why others do.

Elementary, my dear Watson! Asa, Jesus Jim, TailGunner and the black man running for treasurer whose name even Republicans can't remember, may be running for office, but their all dragging a giant anchor called George "Haditha" Bush behind them.

Republicans, especially in Arkansas don't have a chance this November. They're pre-painted by the Bush Brush of Failure and Dishonesty. Bless their tiny hearts, they picked the wrong year to run on the Republican ticket. If they weren't a weak bunch already this Bush thing, this Iraq thing, this Katrina thing, this Abramoff thing is/are a death knell for them all.

Asa has a record any barber can equal as they fight dandruff, pluck ear hair and do their own small part to make America shaver, I mean safer.

TailGunner pops up now and then with a good one and then sinks back into his troubled world of a law practice that has yet to catch on. That damn leash law has really cut into dog bite cases.

The unknown man running for treasurer has my sympathy, but not my vote. I need to send him my bootleg copy of Eyes On The Prize so he'll know which party he needs to belong to.

But without these guys there would be no need for an election. In every boxing match you have to have someone be the bait so the champion can be the winner.

So rave on wingnuts and keep those cards and letters coming in until the anvil of Bush failure drops on the 4 R shaped heads and they can fade back into the woodwork.

If anyone else would care to post on Illegal immigration and Asa's plan to curtail it, please do so.

I think that it is wonderful that we have opened the door to allowing people to break the law and get away with it. What I want to know is what other law are we going to look the other way when it is broken? I just want to make sure that I get something that I want to do that is illegal on that list.

Neither one of these idiots is offering a common sense solution to immigration issues. The main reason is because immigration is NOT a state issue.

RIGHT---Immigration is a federal issue but local law enforcement should not be precluded from enforcing all laws. Illegal immigrants should not be granted immunity to enforcement of laws due to their status as illegals. That is INSANITY. 50 years ago we would not be having this kind of stupid argument.

If you are really intent on impeaching someone how about the Congress and the Presidents who have intentionally looked the other way for the last several years even though they take an oath to uphold the laws of the land.

COMMON SENSE---If you pass laws enforce them.
