Speaking of the Constitution

When the 4th Circuit Court of Appeals says a Republican president is acting unlawfully through indefinite detention at Guantanamo, you KNOW he's waaay over the line.

“To sanction such presidential authority to order the military to seize and indefinitely detain civilians," Judge Diana Gribbon Motz wrote, “even if the President calls them ‘enemy combatants,’ would have disastrous consequences for the Constitution — and the country.”

UPDATE: I note that two Democratic-appointed judges formed the majority in the 2-1 decision. When the Repubs on the 4th circuit get hold of this, it might well be reversed. And a reader notes, correctly, that this isn't about Gitmo specifically, only about the types of tactics Bush has used to populate prisons in his war.

The president got a reprieve of sorts today on another case where his administration has sneered at the Constitution, through the politicization of the Justice Department. A motion to allow a vote on a no-confidence resolution on Attorney General Alberto Gonzales drew a majority of the senators, but not the 60 needed to end debate.

I heard on the news today that Al "torturer" said he would review the Court opinion and advise the Prez whether or not to comply with it.

Iraq and Afghanistan, recruited 5,101 new soldiers last month, short of its 5,500 goal for May. . . ."

Wonder if the spineless legislators of both parties will ignore public sentiment and have courage to vote for a draft, if the trend continues? . . . and what would happen in the following election?

I also wonder what would happen, if Russia or China were to threaten or declare war to further their political aims instead of the Bush administration facing second or third tier militaries in the Middle East.

These are very dangerous times and not because of the Bush administration's terrorist boogeyman. The three thousand plus of the WTC and the three thousand plus of Iraq and Afghanistan could be small drops, if a confrontation with China or Russia arose say for Quemoy or Matsu or perhaps, if Russia decided to reconsolidate one of it's previous satellites for it assets.

The decision does not affect prisoners at GITMO as you are suggesting, The New York times even mentioned that part of the ruling.

From the New York Times, "The decision does not appear to affect the rights of men held at the American naval base at Guantanamo Bay, Cuba. Judge Motz stressed that the court analysis was limited to those who have substantial connections to the United States and are seized and detained within its borders."

It has nothing to do with Gitmo.

The distiction basically comes from weather or not he is a "civilian" or an "alien enemy combatant"

Most of the opinions I have read are saying this will likely be overturned because of this guys terror ties. well see.

It's about time to quit pussy-footin around and get rid of these guys. What's it gonna take, an angry mob of 2 million marching towards Washington?

The Senate voted along party lines for the most part to stop the talk and hold a no confidence vote on Gonzales. I'm sure glad to see Mark Pryor voted with the Democrats this time.

But notice his mentor, best friend, and role model, Joe Lieberman voted with the Republicans to not allow the vote.

Let us remember that Pryor was lied to and walked over like a squashed June bug by Alberto Gonzales. Yet, his dear dear friend Lieberman apparently values his friendship and working relationship with The Torturer more than Pryor who made a fool of himself supporting Lieberman's independent run after the voters in his home state told him to buzz off.

Think Pryor's got it yet that he's been had? That he's been used like a Tampon and then flushed...even by Lieberman? OUCH! That's gotta hurt!

The best 4th of July present this country could have is the impeachment of Gonzales, then Cheney, then Bush by the time we set the fireworks off. Either the Boozman-Republicans in Congress come over to our side, or it's time to start warming up the angry mob.

ARK. BLOG: That is reasonably fair comment. Plenty of latitude is allowed when sharp commentary, even criticial descriptions, are used in the context of specific criticism But the nanny nanny boo boo stuff that is solely name-calling, as in your recent posts, is tiresome. And, after a time, will earn you the penalty box.

The Grim and Barrett show is steadily dropping in its ratings, for sure. You're right Max. Juvenile is the right word. It's a shame that conservatism is represented by such uncouth and uncivil people. (Same holds true for some liberal types, mind you.)
The most telling point to all her entries is that she fails to address the arguments presented to her or that she writes about something completely different to the context of the segment or ,as has become progressively worse lately, she resorts to personal attacks of a mean and vicious nature.
I hope she feels better soon and gets over this bout of adolescent crankiness. She is not doing any of her causes any good.

One of the funniest things I first encountered on the internet was this BJ-like grade-school name calling. I've yet to figure out how calling someone online a silly name...especially without offering any substantive commentary about the issue at hand...is anything but a pitiful commentary about the tragic soul who's sitting at their computer calling complete strangers stupid names.

Be careful and don't run Barrett, chasv, CJ and Prouster off.....they're all we got from the other side of the isle.

Where the AT blog once had great numbers of right-wingers...we're down to a pitiful few. I'd say we've only got about 29% of the wingers we used to have. Gone are the majority of Bush & Huck & Asa defenders. Loyalty ain't what it used to be!

Without them it's gonna be real hard to feel superior to Ecc!, Eureka, zelda and 12 or 13 others who can think and type at the same time.

Another 10 point dip in Bush's popularity and us lefties will have to divide up into pro & anti-Pryor groups and lob uglies at each other. It's probably coming anyway.
