Constitution? What Constitution?

A blogger notes Mike Huckabee's response to a question in this week's Republican debate about taking military action against another country without seeking congressional approval.

In striking contrast to [Ron] Paul, however, the most shocking answer of all was given by none other than the mild-mannered, outwardly likeable Mike Huckabee. The Arkansas governor's public persona is that of a small-town mayor chock full of down-home American wisdom straight from the heartland, measured and never shrill. Yet the friendly farmer down the road evaporated before our eyes, and something awful and Cheney-like appeared in his place, when Matthews directed his question at Huckabee:

"Governor Huckabee, same question. Do you need Congress to approve such an action?

HUCKABEE: A president has to [do] whatever is necessary to protect the American people. If we think Iran is building nuclear capacity that could be used against us in any way, including selling some of the nuclear capacity to some other terrorist group, then, yes, we have a right...

MATTHEWS: Without going to Congress?

HUCKABEE: And I would do it in a heartbeat."

"In a heartbeat" – there goes the Constitution!

On the surface that seems like something we'd all agree with. But that's assuming the President is one of those Made for TV Movie Presidents who only thinks of our country and only does the right thing at all times. Fredrick March as Abe Lincoln, Ralph Bellamy as FDR, Martin Sheen as President Jeb Bartlet.

But any President that thinks there is something more important than following the Constitution to the letter is worse than a fool....he or she's dangerous. Trust me...if some bad juju was heading our way in the middle of the night, the White House switchboard operator could wake up 535 people quicker than you can say Nobel Prize winner Al Gore.

Our founding fathers, you know the dead people spinning in their graves today, knew there would be a Dick Cheney in the future and so they built in checks and balances to keep some misguided fool from sinking our ship of state. What if President Huckabee decided no woman should have an abortion ever? What if President Huckabee decided all 300 million of us needed to be Baptist? What if instead of an Inauguration...he decided to turn it into one giant, nation-wide, Moonie mass marriage ceremony? What if he changed the name from California to Janet?

What if, while looking for quarters under the desk, President Huckabee pushed the Red Button instead? Our spinning founders never meant for 1 frail human to have all the power lest they, after a few drinks or the early stages of Alzheimer's blow us to kingdom come.

Of course history is lost on the Cheney-Bush crowd. They were too busy stealing other kid's milk money at school to pay any attention to history. So none of them understand the wisdom of checks and balances. Today they're too busy stealing the oil in the Middle East to worry about history. And that puts us and the rest of the world in a very dangerous situation. So....no wonder this is Huckabuck's answer. The greed of power has been pulled down over his eyes.....forgive him Father for he know not what he do.....

Huckabee is right.

When New Orleans was going to blazes after the hurricane, he deployed the Arkansas National Guard there with shoot-to-kill orders. He didn't go to Congress and ask them to declare war on New Orleans, he just sent the troops on his own authority. He did what was necessary to stop the anarchy and save the people of the city.

War Powers Act lets the President move in first, as long as he consults (not given permission by) Congress before he does it.

It could literally be calling the Speaker and the Majority/Minority leaders of Congress and telling them what's about to happen. Then, Congress can vote to bring them home in 60 days, or 90 - pending a formal request by the President.

"The War Powers Act of 1973, passed in the aftermath of the Vietnam War, puts limits on the ability of the President to send American troops into combat areas without Congressional approval.

Under the act, the President can only send combat troops into battle or into areas where ''imminent'' hostilities are likely, for 60 days without either a declaration of war by Congress or a specific Congressional mandate.

The President can extend the time the troops are in the combat area for 30 extra days, without Congressional approval, for a total of 90 days.

The act, however, does not specify what Congress can do if the President refuses to comply with the act. Congress could presumably suspend all funds for such troops and override a Presidential veto."

Note there are many qualifications necessary. It's not a blank check.

No, its not a blank check.

But, a President can move first.

The last time I read details of our government claiming someone was trying to make a nuke albeit a dirty nuke, but a nuke nonetheless was Jose Padilla. The US Bush Cheney DOJ tried to claim jose was making a nuke by mixing the ingredients ina water pail and swinging it around really fast over his head, you know, to get the mixture juuuuuuust right.

Anyone with half a days study under their belt would tell you Jose or anyone else would be dead from exposure to the needed ingredients before he got them into a pail. Anyone would tell you swinging ingredients in a water pail doesn't quite do the dirty trick even if you lived or managed not to spill everything on your landlords new carpet.

Look at North Korea who has been TRYING to make nukes for decades with thousands of our troops sitting on their border. *crickets*

Iran has a right to develop a nuclear energy program. Iran has a right to develop a nuclear weapons program. Frankly with genocidal robber baron maniacs like US on two of their borders...who could possibly blame them for doing everything humanly possible to acquire a few nukes?

Who here can trust our government to actually tell us the truth about what they do or do not know about Irans programs? They lied to us about Iraq.. they lied to us about little Jose Padilla and they wiped out entire countries while torturing unknown amounts of innocent people around the world, intentionally based on lies. And we hypocrites have enough nukes to achieve super global warming in minutes.

If Iran had taken full military control of both Canada and Mexico in the last few years would you care what Iran says about whether or not we have nukes? We have Iran surrounded exactly that (Iraq and Afghanistan) way and our leaders do nothing but utter nonsense with horrific threats on Iran daily.

We are the Terrorists of the world, not somebody else. The enemy is right here in Little Rock and DC. Our own hubris and arrogance along with a shocking inability or willingness to scrutinize the available information.

The USA an ongoing criminal cabal in our White House at this very moment and Congress (both parties) is failing us like no founding father ever imagined in their worst nightmare. If we the people don't get it and rise up now our future will be riddled with unitary executives because the precedent has gone way to far with a run of undeclared wars starting with Korea through today. Our VP and P are not following the rule of law now... why should anyone else running for President think they will ever need to?

For Gods sake, Impeach and send them to the Hague!

Correct. Osama Bin Laden wouldn't consult with Congress, and neither should our Terrorist-In-Chief.

There are situtions where the president has to act no matter what the constitution says. He had better or else he'll be an X president.
Most of our enemies are in congress, anyhow.

Nobody has the guts or the power to impeach and you know it so why don't you get over it. Dream on. It will never happen.


I must indirectly agree with Eureka and fully agree with Ron Paul, what we saw was "blowback" a CIA term for when the opposition takes action against repeated antagonisms and intrusions, when your covert "operations" inside other nations blows up your face.
What Eureka implies is a type of worldwide fairness, like the kind we used in the 3rd grade playing marbles for "keeps" without the use of referees.

But the world never played fairly and neither did the U.S. We had the former Soviets intimidated with nuclear missiles fifty miles from their borders when they were sneaking missiles into Cuba. They were afraid we had them elsewhere too that's why they beat us launching a spy satellite. We forgot to mention the 50th birthday of Sputnik on Oct 4. When the Ruskies caught us red-handed and held Gary Powers as evidence for all the world to see in 1960, Gary wasn't a war hero at first. He was near burnt at the stake for failing to use his suicide pin. This pin, which was concealed in a hollowed out silver dollar would have ended his life instantly upon capture. Senators Barry Goldwater and Prescott Bush came to his rescue before the Armed Services Committee.

The U.S. has bombed 50 nations since WWII. How many nations have Iran, Iraq, and Russia bombed?
How many Declarations of War has Congress issued since WWII?

How many lives per gallon will your candidate get?
