Case dismissed
Two weeks into trial in Circuit Court here, the lawsuit against Arkansas Children’s Hospital's insurer over surgery on the wrong side of a boy's brain was dismissed today at the request of the plaintiffs.
The request was for a "voluntary nonsuit." The case could be refiled within the next year.
The parents of Cody Metheny argued he suffered permanent damage because a surgeon mistakenly began the operation on the wrong side of the brain. The doctor has settled out of court.

From what I have heard, surgeons work 80+ hours a week. Seems to me that we need to do something about that, so things like this will be less likely to happen. I don't know of anyone that can work with so little time off, and probably not enough sleep.
We really need to work on our health care system, ASAP.

Start quickly!
If you cut the hours to 40, you'll only need to double the number. Since it takes 10 years to train one, you're already at 2018.

The article in today's DG had a few more details about the case. Namely, that the plaintiff's lawyer asked for a mistrial because of juror misconduct and The Honorable Ellen Brantley didn't give it to him. Evidently when you are losing a case and the judge won't let you blame it on the jury you ask for a voluntary nonsuit in order to get a different judge the next time around. Pathetic.

Arkansas Children's is a great hospital, but it seems the lawyers defending this case for the insurance company don't care about the hospital or the child that had wrong side brain surgery there. It's about time someone stands up to the insurance company and does the right thing for all our kids to make them safer. Interesting that the Hospital called their lawyers before ever telling the family what really happened. If my child gets hurt, I sure hope you don't call your lawyer first.

Hey, mudturtle, how about letting more actually get into med school, and helping those that can't bring themselves to take on thousands of dollars of debt, or just can't swing it, to pay for med school?
It's pitiful how people think that there is nothing that can be done about getting more doctors and other health care workers. Stop putting roadblocks in their way and the numbers will increase.
