The terminology comes to mind on news of a McDonald's motion to dismiss the lawsuit over cell phone nudie pix that supposedly hit the Internet after the phone was left in a Fayetteville golden arches. To date, the tale of Internet photo circulation has not been proved with verifiable links, though some photoshopppers have had sport with the concept. (You're on your own.)

COUPLE: We're gonna 'accidentally' leave our phone, you come and 'find' it, ok?

COUPLE: When we sue McD's for not taking responsibility, we'll get a HUGE ca$h settlement...

Seriously though, anyone STUPID enough to keep naughty photos on their cell phone of their SO plays with fire.

"Matthews Management Company, which owns the restaurant, filed a motion to dismiss Tuesday. The company contends that even if true, the alleged conduct by its employees would be outside the scope of their employment and Matthews Management would not be liable for those acts. The company also contends it owed no legal duty to protect the Shermans against the acts alleged."
My bet is that the motion to dismiss will be dismissed.

That is exactly what I would have done if I were representing Matthews Management. I would have alleged that the employees actions were ultra vires. It may not work but legally it is the smart play.

Republicans favor "millionaire tax." Not making this up. From a Quinnipiac poll on NY's proposed Obesity Tax on non-diet soft drinks:
"New York State voters oppose the so-called "obesity tax" on nondiet soft drinks by a resounding margin of 60 percent to 37 percent, but support, by an even more overwhelming margin of 84 percent to 13 percent, raising the state income tax on people who make more than $1 million per year,..."
Meanwhile, support for the so-called "millionaires' tax" extended even to Republicans, who favored the measure, by a margin of 72 percent to 27 percent. Gov. David A. Paterson has expressed opposition to raising taxes on wealthy voters, but has suggested that there might be no other option if the state budget crisis continues to fester."
