Rep. Donna Hutchinson, you may remember, brought Arkansas legislation in 2007 to make a crime of so-called "upskirt" and "downblouse" photography, in which shooters take photos of publicly displayed naughty regions, including where clothed.
That legislation apparently didn't go far enough. She has filed new legislation that would make it a Class A, rather than Class B, misdemeanor offense of video voyeurism, to give such images to another or to post them on the Internet. The news photo that inadvertently catches a glimpse of underthings? Could be a problem, all you cheerleader photographers.

So Max, say your daughter is wearing a skirt...not a skimpy skirt but a skirt all the same. She is standing on a stage of sorts and due to problems with panty lines decided to go comando. Some creep takes a photo from the ground and next thing you know her crotch is all over the web?
Along with the photo of her privates is a photo of her face. Due to the embarassment she ends up losing her job, because the photos went viral.
Or say you have an 8 year old grand daughter. She has a little sun dress on and some how some perv gets a shot under her dress and posts it on porn sites.
So instead of perhaps thinking MAYBE someone is trying to protect our children in an age that technology cannot keep up with laws...you assume this must be Republicans stuck on sex? MAN it must be a sad, corrupt conspiracy ridden world in that lil head of yours.

Security monitoring by owner or occupant of a building pretty much lets everyone off the hook except for "freelance" "monitoring".
Those are my quotes.
This allows a hotel owner or bar owner to record stuff under the guise of "security". Then post it however they want to with no recourse.

The way this legislation is written does not protect the way it appears.
Since the "exceptions" with this bill an owner can "monitor for security" Max's daughter or little grand daughter can be be recorded trying on bikinis or intimate apparel and the "owner" could do whatever he wished.
You may agree with the intent of the bill but it is lacking in its present form.
A poorly crafted bill is usually worse than no bill at all.
Just ask Nebraska about their new "safe harbor" law which is allowing parents to abandon kids of all ages with no recourse.

Anyone going commando on a stage has assumed at least a little of her own risk.
I spent half the day trying to "fix" a group photo with a beaver shot of one student. Would hate the see the photographer in jail if the editor hadn't caught it.

Why not pick one color, say white, and make it illegal to show panties of that color. Like who wants a picture of WCP's? Any women wearing any other color, I prefer leopard skin, gives tacit consent. Any thong or commando is fair game.

It pains the heck out of me that Americans are so up-tight about our bodies. I can only think it is caused by the so called morality spewed by the religious pukes and thought police. Tite ass prigs everyone of them. America has a hang up that contributes to many of the legal & social problems related to sexuality & sex. This is not just about beaver shots, this is a sidebar to the general suppression of anything related to sexual practices other than the "purity" aspect proscribed by the church. Geeze louise, get over it, the more the protests the more the interest and the more the photos. Call Europe Old Europe but by gawd they have the correct view on sex, sexuality and the human body.

The other aspect to these Sarah Palin, Donna Hutchinson, and yes, Mark Pryor types... is what we all need to be keenly aware of.. they will kill internet neutrality with anti porn laws... for big money from Telcos and Cable companies if we let their little naked fears to go unchallenged.
Pryor slipped a anti porn bill through both the House and Senate during the bailout week... without any recorded votes... for just the purpose to which I am referring above.

The greater goal is control of the media, esp internets, which now offer the possibility of yes, more porn but in the end more political coverage.

There are already laws that prohibit the sexploitation of minors. Now get busy and raise enough taxes so police and prosecutors have enough money to enforce them.

Where is Dr. Freud when we need him? Years ago a Fort Baptist city director spotted a T-shirt that offended him. He raised a giant stink that went on forever, he proposed a review board to jail obscene T-shirt wearers and in the end made sure that 80,000 people saw or at least knew about the T-shirt. If the old man had kept his mouth shut maybe 23 people would have seen the shirt.

Obviously Mrs. Hutchinson has all kinds of personal hang-ups that are coming to light. And I agree....maybe we're slowly learning why Tim chose to leave his fine Christian wife and home. But I also agree it's a Republican ploy to control the media and make every human action punishable under some draconian law. If this shit keeps up, most of us will have to arrest ourselves before we get out of bed every morning. It's getting so tight....I can't hardly breath!
Sexually molesting and beating to death a TV personality is a long long way from some jerk with his cell phone camera. It's today's equivalent of putting frogs down a girl's blouse or knocking over an outhouse. No.....I don't want to ride an outhouse down the hill, but one more thing to think about...
Logan's Run pretty much summed it up. Human attractiveness has a short shelf life. If you're hot now, enjoy it while it lasts because ahead of you are years and years of no one taking your picture except at weddings and funerals and only because it would be too awkward to ask you to step away from the group. You spend far more of your life being old and ugly than you do being young and pretty. Enjoy it while you can and don't sweat the small stuff. If anyone ever looked at my picture and rubbed themselves it was back when Gerald Ford was in office. Since then I've been invisible to the world. Oh how I'd love to be "up-pants" or "downshirted"!

This legislation or where this legislation might lead is meant to PROTECT people!! I don't want pictures of my ass showing up on the internet and if anyone dared try to violate me in that way they either a) need to be prosecuted or b) I will take the handgun I legally own and deal with it myself...my body is MY body and the laws need to catch up to technology to protect me from slime ball idiots.
There are plenty of sites you may go to look at pornography that are covered by the right to free speech. Taking photos of someone's intimates or intimate areas without their knowledge or consent should in no way, shape, or form by covered by free speech. Based on the comments I am seeing here....I think I have found who thinks about sex all the time. Geez you people would rather protect pervs than children? Get a flippn' clue!

I don't vote for moralizing, look around next time you do. I suspect hypocrisy has no limit.
When the SCOTUS voted to allow infra-red cameras to photograph what was going on inside a house the conservative court abandoned all pretext of privacy or warrants. Since there was never a right to privacy in public, I can photograph anyone through their clothes with IR equipment, surprise. Did you just wake up and discover the constitution being used as toilet paper or what?
