News never takes a holiday

In theory, everyone at the Times is off this week. But we're trying to keep the blog alive through a network of contributors and periodic e-mail checks.

Sounds like the ACLU is about to announce its lawsuit against Act 1. The backers have previously said they are confident it will withstand challenge. I noticed in the news today a successful federal challenge of a law in Louisiana that prevented the two adoptive fathers of a child (married in California) from both being listed on that state's birth certificate.

 

What:      Act 1, a new law passed in November, bans any unmarried person who lives with a partner from serving as an adoptive or foster parent in the state of
Arkansas .  The American Civil Liberties Union has been talking with people all over the state about how the ban hurts their families and will be making an important announcement about new legal developments regarding Act 1. 

 

Who:       Families hurt by Act 1 who can explain how the law impacts their families; Marie-Bernarde Miller, an attorney with Williams & Anderson PLC of Little Rock; and
Rita Sklar, Executive Director of the ACLU of Arkansas.

Why:        Arkansas Act 1 denies parents the right to decide for themselves who will adopt their children if they die, denies the many children in state care in Arkansas a chance at the largest possible pool of potential foster and adoptive homes, and denies cohabitating couples the chance to provide homes to children in need.

THAT (LA law) is the REAL objective here, as I've been opining since about forever: Take AWAY kids who have been legally adopted, including those of lesbian couples with an actual BIRTH mother being one. And of course also deny their adoptive rights in the future.

We must remember this has NOTHING to do with kids, their safety/well-being - as Max faithfully points out each time, it's about "punishing" gays for being.........gay. Do NOT forget it!

Larry, you are absolutely correct. And to the punishment theme I would add, anti-Constitutional. The opponents of the Act made a flawed strategic decision to fight it as a children's issue. It is a Consitutional issue, has always been a Constitutional issue, and should finally be fought as a Constitutional issue. We missed a golden opportunity to hold the principled mirror of the Constitution up to the faces of the Cox Family Bigots so they could plainly see what they were; anti-democratic bigots in the same tradition as the segregationists before them.
