Souter to retire

Looks like President Obama will have a supreme court appointment to make.  Supreme Court Justice David Souter is planning to retire at the end of the current court term.  From NPR:

The vacancy will give President Obama his first chance to name a member of the high court and begin to shape its future direction.

At 69, Souter is nowhere near the oldest member of the court. In fact, he is in the younger half of the court's age range, with five justices older and just three younger. So far as anyone knows, he is in good health. But he has made clear to friends for some time that he wanted to leave Washington, a city he has never liked, and return to his native New Hampshire. Now, according to reliable sources, he has decided to take the plunge and has informed the White House of his decision.

What's the matter, blackberry. Can't stand sanity in a Supreme Court justice?

I think Lewis Black is the only man to take Souter's place on the court. We've already had a Justice Black and it turned out pretty well, since Hugo Black has been called one of the most influential Supreme Court justices in the 20th century.

We also did pretty well with Justice Harry Blackmun who was appointed by Ike, but became the author of the court's decision on Roe v Wade, the favorite decision of the wingnuts exampled by our friend blackberry. Black, Blackmun, Black......damn...I like the sound of that!

Justice Lewis Black would speak plainly to the wingnuts on the court who gave us 8 FK'ing years of Cheney-Bush. Lewis was born in DC and knows the lay of the land, he isn't an angry Uncle Tom like Clarence Thomas, he's not a mafia butt-buddy of Dick Cheney like Scalia, he's not prone to passing out and talking nonsense like Chief Justice Roberts, he's not a Bush-sucking Klingon like Sam Alito, he won't duck out on his country and then bitch later like Sandra Day O'Connor.

If Jusice Lewis Black wouldn't be a Republican's worst nightmare, then I steadfastly stand behind whoever is. Nothing Obama can do to the Supreme Court, no one that he'll nominate can punish the rat bastids who gave us Cheney-Bush, war, Katrina, secret black site prisons, kidnapping, HomeLand Insecurity, the death of habeas corpus, torture, torture, the death of 4278 Us soldiers, 181 dead in Iraq by their own hands, hundreds of thousands of dead Iraqis, wire tapping, a FK'ed Justice Department, 4 dollar a gallon gas, Jeff Gannon/Guckert, Heck of a job, Brownie, Bush's nearly 1000 vacation days in office, Mission Accomplished....and on and on and on and on and on....

If not for the old Democrats on the Supreme Court I'd recommend that Charles Manson be put on the court, lock the doors with him in there and let him have at em! Lewis Black or Charles Manson...... or I'll take Al Sharpton for 1000, Alec!

THIS, Barry, may well be the biggest thing you ever do in your Presidency. Or your life.

For SCOTUS nominee I vote for a Chicago woman, Judge Diane Wood.

Blackmun of the United States Supreme Court, 1976 Term. After a brief period at the Office of

from 1978 to 1980, where she had a wide-ranging litigation practice with particular emphasis on
antitrust. From 1980-81, she taught as an assistant professor at the Georgetown University Law
Center. In 1981, she was appointed to the University of Chicago Law School faculty, where she
served as Associate Dean from 1989 through 1992. In 1990, she was named to the Harold J. and
Marion F. Green Chair in International Legal Studies, becoming the first woman at the Law
School to be honored with a named chair. Immediately prior to joining the Court, Judge Wood

Diane P. Wood was appointed to the Court of Appeals for the Seventh Circuit by President
William J. Clinton on June 30, 1995. Judge Wood was born in Plainfield, New Jersey, on July 4,
1950. She lived in Westfield, New Jersey, until the age of sixteen, when she moved to Houston,
Texas. She attended the University of Texas for both college and law school, receiving her B.A.
with highest honors and special honors in English in 1971, and her J.D. with high honors in

Yeah, elwood...I want a woman, a real one, of course; not some white-male nut version of a woman (talking to you, Sarah). One who loves all her brothers/sisters but knows that we're not equal yet, despite all the right-wing propaganda to the contrary...knows that women are still underpaid for the same work done by their male counterparts, are still sexually harassed, are still in mortal danger from violent asshole boyfriends/hubbies, are still in second place when it comes to funding for our gender's diseases/medicines, are still encountering glass ceilings, are still under-valued as homemakers/mothers. (For a culture that allegedly adores/values everything related to 'The Family' we sure treat stay-at-home moms like crap...why don't they deserve fiscal respect?!)

But mostly I'm thrilled that the McCain/Palin team ain't picking our next judge. Holy crap...I don't even want to imagine such a choice.

So, the SCROTUS presently has 7 Repubs and 2 Democrats. It will now be 6-3. Watch the right scream about anyone Obama selects as they declare the country is heading to ruin. These dumb butts have controlled the Executive Branch, the Legislative Branch and the Judicial Branch and still can't comprehend their role is the present conditions in the United States of America and the world.

I want a woman too, Zelda. I couldn't have outlined the reasons why better than you.

I too would favor a woman especially given the quality of potential candidates being mentioned at this point. I would add, however, that she should have some elected political experience. Part of the abilities of Sandra Day O'Connor, especially to build consensus within the court, stemed from her having held elective office. I think the pragmatism and understandings gained from those experieces would serve a new Justice and the People of the United States well.

My personal thanks to Justices Souter for delaying his life plans till Bushco left. The fellow is 69 and obviously wanted to move on some time back but knew he needed to outlast Poo for Brains.

Also my deep appreciation to Ginsburg for clinging on for the same reason. That woman is a true American hero. She had multiple reasons for retiring and letting W further contaminate the SCOTUS. Advanced age and expected terminal cancer did not disuade her from staying till a "Decider" with an IQ higher than Kool-aid was installed.

Bill Maher had a great line the other night. He said the American people wanted someone would could spray the whole country with a can of "Bushbegone." And, as you guys have well stated, this is one of the crucial reasons why. To think that we're going to have to deal with Chief Justice Roberts probably until I'm in the rest home does not give me peace. And I'm not that old.

Let's spray "Bushbegone" into every nook and cranny of our government.

I have no doubt that the person will be both intelligent and capable (no more Clarence Thomases). But it's high time that the Supreme Court looked at least a little bit like the rest of America. I know conservatives supposedly despise quotas, but man I think we hit the "old white guy" quota a while back!

A gay woman would be perfect! If she's black or hispanic, even better!
