Three-way race for court

Add a third candidate to the race for Supreme Court to fill former Justice Tom Glaze's seat. It was filled in the interim after his retirement by Elana Wills, who cannot run for the job.

The latest candidate is Appeals Court Judge Karen Baker of Conway, who notes in her announcement her authorship of the recent opinion reversing the PSC approval of a permit to build a caol-fired power plant in Hempstead County.

Appeals Court Judge Courtney Henry and Circuit Judge John Fogleman had announced previously.

This one could be a runoff in the making, with candidates from Northwest (Henry), Central (Baker) and Northeast (Fogleman) Arkansas.

Judge Karen Baker, 45, currently in her ninth year on the Arkansas Court of Appeals recently told separate meetings of the Association of Arkansas County Judges, County Clerks and County Treasurers that, although she had not yet officially announced her candidacy, she intends to seek a spot on the Arkansas Supreme Court next year.  Baker recently wrote the majority opinion reversing the Arkansas Public Service Commission’s grant of a CECPN to build the Turk Coal Plant in Hempstead County .  Before her election to the Court of Appeals in 2000, Baker was a Circuit trial judge for the 20th Judicial District. She was introduced to the Arkansas Treasurer’s Association by Marcus Vaden, President of the Arkansas Prosecuting Attorney's Association and Prosecuting Attorney for the 20th district, who said of Baker, "We need someone with her experience as a trial lawyer, a trial judge and an appellate judge on the Supreme Court."

Baker said that, with over 22 years experience as a lawyer and over fourteen years as a trial and appellate judge, she is qualified for the Supreme Court. "This is an important job. The Supreme Court makes decisions that affect your life. You need look no further than the Lakeview case and the resulting school consolidation to see that the decisions of the Supreme Court impact the lives of all Arkansans."  
                
Noting that she had been encouraged to run for this position by colleagues convinced that an experienced Appellate Court Judge should seek the Supreme Court seat,  Baker pointed out that she had written about 500 opinions and participated in approximately 2000 decisions as an appellate judge and presided over thousands of cases as a trial judge.  In describing her rural Arkansas background, Baker said that she did not come from a family of lawyers or politicians.  "My qualifications are my own," Baker said.

Baker and her husband, David Hogue, live in Clinton and are the parents of 3 children, ages 14, 9 and 7 years.

Having known Karen Baker for over 20 years, I am pleased of her announcement to seek the Supreme Court position. Karen Baker has the experience and qualifications as a trial attorney, circuit judge, and Appellate Court Justice that would serve Arkansas well as a Supreme Court Justice. I urge everyone to support and help elect Justice Baker to the Arkansas Supreme Court.

Early prediction: If these are the only 3 candidates, Fogleman will narrowly lead the primary ballot. In the runoff, he will lose to either Baker or Henry, probably Baker.

Clearly, Karen Baker is the top choice for Supreme Court judge.

I am so excited about Judge Karen R. Baker's decision to run for the Supreme Court! She was a great lawyer, she was a great Circuit Court Judge, she is a great Court of Appeals Judge and she will be a great Supreme Court Justice! She is simply brilliant with rural hometown roots, growing up among the common people that make up the great State of Arkansas. She was not born with a sliver spoon in her mouth nor is she an ivory tower judge. She is the salt of the earth with an astute mind for fairness and justice. Bravo, Judge Baker, for coming to the needs of the Arkansan people!

Karen Baker is such a bad judge that she'd make the clowns who currently populate the Supreme Court look competent. She is so plaintiff-biased that she will simply make up the law to suit her purpose of making sure the plaintiff wins.

For an example, read her dissent in McAdams v. Curnayn, 96 Ark. App. 118 (2006), then read Hamilton v. Allen, 100 Ark. App. 240 (2007), where the Court expressly repudiates Baker's remarkably stupid notion that a defendant--who does not have the burden of proof--must present proof in moving for summary judgment. Take care to read her idiotic dissent in Hamilton in which she steadfastly clings to this plainly incorrect position. Footnote 1 in the majority opinion dispatches Baker's position fairly simply and very effectively. But Judge Baker does not care because she cares only that the plaintiff wins, regardless of the legal merit of his/her position.

Judge Baker is just a bad judge. Either Henry or Fogleman would be immensely better.

Recently I had the privilege of meeting Judge Baker. I am excited to know there is a woman with her experience and background running for our Supreme Court. She will have my support during this campaign.

I'm glad to see that you are supporting both Henry and Fogelman, as I'm sure Judge Baker doesn't need any losers campaigning for her! So carry those axes to those camps and grind them, aye? Your shortsightedness with your blinding anger failed to see that Judge Baker, in those two aforementioned cases, is a strong believer in the jury system and that one should not be denied their day in court if there is any question that the jury should decide. You'll see no totalitarian "justice" out of her, Bozo!

I have known Judge Baker for about 15 years. She will make an excellent addition to the Supreme Court. Her experience as a trial lawyer, Circuit Court Judge, and Court of Appeals Judge makes her a great choice for the Supreme Court. If you look at her work history, it is clear that her decisions are based on the law-not emotion or politics. She would be unbiased and fair. I urge everyone to support her candidacy.

You have a hardcore bizarre imagination as well! Apparently you missed my first posting, talking about showing your ass! It was more like you were having fun at Judge Baker's expense and so very tacky and rude! If you're not a supporter of Judge Baker, why do you even come back here? My opinion of you has NOT changed. I've known Karen Baker for 25 years. I know her to be a very talented lawyer and to have been a very good and hardworking circuit judge, and I know she is a very good appellate court judge who has worked very hard for the people of this state. That's 3 for 3 and the people of Arkansas would do well to make it 4 for 4. Her knowledge and skills are precisely what's needed on the Supreme Court and we could quite literally not make a better choice.
