Words matter, even prepositions

Apparently, if you are "in" a building, it is impossible to shoot "at" the building. So says the Texas Court of Criminal Appeals, when they threw out a conviction of a man for discharging a firmarm inside his apartment. He was charged under statute that enhanced for shooting "at or in the direction of" a building, commonly used to for drive-by shooting crimes. Firing "at" a building requires the shooter to be outside the building, the Court of Criminal Appeals said in a 6-3 ruling. If the lawmakers meant to include shooting "in" a building, they could have chosen another preposition, Judge Cheryl Johnson wrote for the majority. Makes sense to me.

Yes we can

I'm expecting Barack Obama to win on Tuesday, but it's not a sure thing by any means. Assuming he does win, his victory will signal a huge shift in the political paradigm. Of course, both candidates say they want to be bi-partisan, but candidates always say that. With luck, there will be a significant number of Democratic House and Senate seats. While Pelosi was ridiculed for saying so, she said that if there are significantly more Democratic seats, there will be greater bipartisanism. I think she is right - with Democrats firmly in control, Republican congressman will be freer to worth with the majority, knowing they can't just dig in and force gridlock.

Assuming Barack wins, I for one, will celebrate, but will not gloat. This can be a great opportunity for forgiveness and reconciliation. Even today, I saw an official Republican party blog trying to scare people because they claim Barack "used to be a Muslim." As shameful as this scare tactic is, there is no need for retribution after Tuesday. I have some requests if he wins:

1. I hope Barack commits to being bi-partisan by appointing some moderate Republicans to key posts.

2. Like has occurred in other countries where there was major political shifts, I think there should be a "Truth and Reconciliation Commission."  I have no doubt there are dozens of high ranking Republicans that have committed serious crimes that we still don't know about. While many deserve jail ( for example, Karl Rove ) I think Barack should go so far as to give pardons for political offenses. Like after Watergate, this nation will take a long time to recover from the corrupt practices of the Bush administration - but we would be better served by having the truth come out.

3. I think we should make the Democratic big tent bigger. Back when Republicans took over both houses in the  90's, several conservative Democrats switched party. I think the Democratic National Committee should encourage the few moderate Republicans out there that there is room for them in our party and in the administration. A record number of Republicans elected not to run for re-election this year because being the minority party just is more frustrating. We have room for conservatives who are respectful of Democratic values for sure. They should be encouraged to climb about what is sure to be an exciting next two years.

I'm not saying an Obama presidency will usher in a utopian society. But an Obama vicotry will have long lasting effects. If he wins it will mean a vicotory where the average donor gave $86.00. It will mean millions of people will for the first time feel true empowerment and that their vote really mattered. I just hope it will also mean a return of dignity to politics and once again make the office of the President worthy of honor and respect.

Law firm names have always driven me crazy.  I’ve worked for firms where people fought to get their name on the letterhead.  I always thought the traditional naming convention of placing the partners’ last names in a long string of words was pretty idiotic.  Why would a company full of massive egos create the potential for yet another ego fight?

Who I Voted For

I voted on the 20th at the downtown early voting location across from the courthouse. I highly recommend it because on the 4th, if it's anything like 4 years ago, there will be an hour or more wait.  You can find the early voting locations here.

Who did I vote for ?

Barack Obama. The best Democratic candidate we have had since Clinton.  He will fix the mess the Republicans have gotten us into, restore the respect the U.S. used to have in the world, and do great things.

Mark Pryor.  Even though he is probably the most conservative Democrat in the Senate, he represents Arkansas interests well.

Vic Snyder.  I can't once remember disagreeing with anything he has ever voted for.

Judges

These are harder, because everyone running would make a fine judge. I hope the candidates who don't win don't get discouraged.

Little Rock Criminal Court

My former co-worker, Hugh Finklestein will be tough, but fair, and hopefully more patient than Judge Munson.

Little Rock Environmental Court

I think Gary Sullivan has a great temperment to preside over this court.

Pulaski County Circuit Judge, District 11 ( Juvenile Court)

I'm backing Cathy Compton.  I think with her long history of criminal defense work, she will be sympathetic to defendants, but at the same time she will know when the are full of it. I'm going to have to work in this court some,  and I am confident she will be efficient and fair.

Little Rock At-large Representative

I'm going with Glen Swartz on this one- we have too many establishment types in city government as it is.

Pulaski County Judge

I think our current county judge has been there too long. I actually voted for a Republican ( I usually find at least one I like )  Phil Wyrick sounds much more sympathetic lately to environmental issues and I think he will be better at getting the county budget back on track.

Amendments and Initiatives

CONSTITUTIONAL AMENDMENT 1: This corrects some archaic language concerning who can vote. For example, it takes out language preventing "idiots" from voting. Vote YES.

CONSTITUTIONAL AMENDMENT 2: It provides for annual sessions of the legislature, including a financial session in even-numbered years. I think the legislature gets all it needs done every other year. If passed, this will cost us more just to have the legislature in town more often.  Vote NO.

CONSTITUTIONAL AMENDMENT 3:

I voted for the lottery. It might not raise as much as Lt. Gov. Halter predicts, but with us being the only state in the area, we are just seeing good money go to support our neighbors.

 Initiated Act 1

This is the homophobes attempt to prevent foster kids from being raised by gay or lesbian parents. We should trust our judges to decide who can adopt from the state, and trust our state agencies to decide who is appropriate to be a foster parent -- not the  (Anti-) Family Council. Vote No.

REFERRED QUESTION 1: It would provide state backing for $300 million in bonds for water and other projects. This isn't a good time to issue bonds, when we aren't sure about the markets.  Vote NO.
