Appeals Court Judge Wendell Griffen has asked that Judicial Discipline Commission Chairman Michael Gott not participate in hearings about Griffen later this month. Reason: Gott had forwarded to the Commission staff information being used in another case alleging judicial conduct violations by Griffen, specifically his comments on public issues in an e-mail letter his campaign for Supreme Court distributed.

Said Griffen in a motion for Gott's recusal: "To the extent that Chairman Gott has referred information to Director [James] Badami as part of another judicial misconduct investigation against Judge Griffen, a reasonal questions exists regarding whether Chairman Gott is, or can be considered, a neutral and impartial arbiter of the facts surrounding the misconduct allegations in the instant case."
