Cause of action

Posted By on Mon, Apr 30, 2007 at 5:26 AM

Uh oh. Channel 4 report on the LR school turmoil quotes Board member Michael Daugherty as saying he spoke briefly with Board president Katherine Mitchell about her letter to select administrators warning them of possible job changes.

Arkansas law is clear. Two Board members cannot meet in private on board business. They may not use a telephone round robin to arrive at a decision on an official action. Is this an FOI problem? One immediate response is that no "Board" action was taken as a result of that communication. Action arrived at in an illegal session can be voided.
