Adoption initiative turned back

Attorney General Dustin McDaniel has turned back a proposed initiated act aimed at preventing adoption or foster parenting by unmarried couples. He cited lack of an enacting clause and problems with the popular name and ballot title.

The Family Council will presumably work to fix the problems and submit another.

Here's the full opinion.

One sore point is the attempt to put in the ballot title a preamble's "finding," by whom we know not, that marriage is the ideal home environment and unmarried couples who raise children increase the risk for drug and alcohol abuse, domestic violence, instability, etc. The Supreme Court has said ballot titles need not include preamble language, particularly those that may raise more questions and than answers. This is clearly inflammatory partisan stuff, as is the specific mention of same-sex couples, designed to win favor for the act by inflaming voters.
