Campaign finance

Attorney General Dustin McDaniel has issued an opinion addressing purely hypothetical questions (hmm) about legislation introduced in 2007 but not adopted to put some new restrictions on campaign contributions. The questions were posed by Prosecutor Brent Haltom of Texarkana. The measure would have, among others:

Lowered the state contribution limit from $2,000 to $1,000 per election (probably consitutional, McDaniel said)

Made it impossible for business entities with the same ownership to give multiple contributions (probably constitutional in theory, though perhaps not as drafted)

Allow candidates to make political contributions from campaign funds but not officeholders from holdover campaign funds (probably NOT constitutional)

McDaniel also said he doubted there was a constitutional problem in the fact that a political candidate -- by being able to contribute from both a campaign fund and personally -- could give more to a candidate than an individual.
