No death penalty for child rape

The U.S. Supreme Court today struck down a Louisiana law permitting the death penalty for people who rape children. The vote was 5-4. The four were naturally Roberts, Alito, Scalia and Thomas.

"The death penalty is not a proportional punishment for the rape of a child," wrote Justice Anthony Kennedy in his majority opinion.

This reminds me, somehow, of the dangers posed by a John McCain Supreme Court.
