College buyouts ok?

Posted By on Thu, Feb 12, 2009 at 4:25 PM

May colleges make severance payments or pay for "sabbaticals" for college administrators, professors or coaches who have resigned or been terminated? That was the question put to Attorney General Dustin McDaniel. The official opinion answer, to vastly oversimplify, is "no." But the opinion says there clearly might be room for payments when contracts provide for severance payments or when payments to departed parties are part of settlement of legal disputes. (See Roy Brooks and LRSD.)

The question, yes, arose from the Lu Hardin buyout at UCA. Does this opinion hold meaning for it? James Jefferson of Stephens Media explores. Maybe. Maybe not.
