Who owns the Arkansas lottery? UPDATE

Check out this link. No, the new state lottery, shortly to become law with Gov. Beebe's signature has nothing to do with this website. But I suspect we haven't heard the end of the coincidence of an Arkanas Lottery website, with its trademarked Arkansas Lottery, Arkansas Lotto and Arkansas Powerball promotions.

The website and the trademarked names are property of Ed Dozier, a long-time local ad man. He says he trademarked Arkansas Lottery 16 years ago for use in radio station promotions. He licensed it recently to a Little Rock station that encouraged call-ins for the "Arkansas Lottery" as an audience building device. Prizes were drawn at random at the end of the promotion. There was no gambling.

(Secretary of State's registration (link fixed) shows Dozier obtained the trademark in 1994 and the current trademark registration is good through 2023. The powerball and lotto registrations also date to 1994.)

Now Dozier is also selling T-shirts with Arkansas Lottery emblazoned on the front.

"I don't want to get in any fight with the state," Dozier said. "But I don't mind making a profit tailgating on what they do."

He objected to a newspaper's recent mention of  "the Arkansas Lottery" in a news article. That's his name, he said. He said that shouldn't be a problem because he understood the state lottery would be known as Scholarship Lottery or something similar. Would he sell the name Arkansas Lottery? "Anybody would sell anything," Dozier said. For now, he's selling T-shirts.

UPDATE: For the record, Dozier trademarked these names in September 1994, shortly before Arkansas voters were to consider a constitutional amendment permitting casino gambling at Oaklawn and Southland Parks. Coincidentally, the amendment also authorized a state lottery. Voters soundly defeated the measure.
