As generally expected, the California Supreme Court has upheld the voter initiative that banned same-sex marriage in that state. This should commence a petition drive to overturn the ban. The decision kept intact marriages entered before the ban.

Even with the court upholding Proposition 8, a key portion of the court’s May 15, 2008, decision remains intact. Sexual orientation will continue to receive the strongest constitutional protection possible when California courts consider cases of alleged discrimination. The California Supreme Court is the only state high court in the nation to have elevated sexual orientation to the status of race and gender in weighing discrimination claims.

Chad Griffin, a Hope native, former Clinton aide and now a bigshot political consultant in Los Angeles, could emerge again as a leader of the same-sex marriage forces. He helped find financing for “Outrage,” the new political documentary on closeted gay politicians.
