Court dismisses Scout abuse case

Posted By on Thu, Jun 25, 2009 at 11:56 AM

The Arkansas Supreme Court today affirmed a summary judgment against a man arguing, among other things, that repressed memory syndrome should override the statute of limitations and allow him to pursue a case against a former Scoutmaster for sexual abuse 30 years ago. He'd sued the Scoutmaster, the church that sponsored the troop and the insurance carrier. The Court didn't squarely reach the question of whether the syndrome affected the statute of limitations. It said the plaintiff hadn't proved he suffered from the syndrome before reaching the age of majority. That would have been necessary to extend the period.
