* Circuit Judge David Burnett has refused a defense request that he disqualify from hearing the post-conviction relief petitions in the 1993 case because he is a candidate for political office (state Senate). Burnett had been unreceptive to earlier arguments in the case, specifically defense argument that an absence of DNA from the three convicted in the crimes merited an overturning of their convictions.

* Defense witness says wounds on three children killed were caused by animals, not a serrated knife as prosecution had alleged. Also says no evidence of beating of dead children. Witness believes drowning was cause of death.

* Outside the hearing, John Mark Byers, father of one of the children killed, said he believed the WM3 were innocent.
