Death penalty reinstated

The 8th Circuit U.S. Court of Appeals today reinstated the death penalty for Marcel Wayne Williams, who abducted, robbed, raped and killed Stacy Errickson in 1994. He buried her in a shallow grave in North Little Rock.

Federal Judge Leon Holmes had overturned the penalty by ruling in favor of the argument that Williams had been denied effective counsel because his trial lawyers had not adequately developed information about his troubled life, a potential mitigating factor. He ordered a new sentencing phase of the trial. The 8th Circuit upheld the conviction and overturned the order for a new penalty trial.
