Who's an enemy combatant?

The Republican talking point of the day is that the pants bomber should be tried in a military court. Josh Marshall notes that Republicans were happy to try the shoe bomber in a civilian court under nearly identical circumstances during the Bush administration. What's the diff now?

The theme is being pushed all over Fox. It adds up to the simple message: Obama is weak, Dems are wimps. We need a chickenhawk like Dick Cheney back in charge.
