Nov. 20 could be another judgment day for marriage equality in Arkansas

Federal Judge Kristine Baker has scheduled a hearing Nov. 20 on the federal lawsuit that challenges the constitutionality of Arkansas's bans on same-sex marriage.

At 1:30 p.m. that day she will hear two competing motions: 1) The plaintiffs' motion for summary judgment and 2) the state's motion to dismiss the lawsuit for failure to state a claim.


Federal courts have ruled, with a single district court exception, that state bans on same-sex marriage and the failure of states to grant rights to people legally married in other states cannot stand.

In a separate state court lawsuit, Circuit Judge Chris Piazza has struck down the state ban.  That case is on appeal to the Arkansas Supreme Court and plaintiffs are trying to expedite it.
