Arkansas Supreme Court silent today on same-sex marriage case

Times photographer Brian Chilson reports from the Arkansas Supreme Court that this week's list of decisions by the court includes nothing on the pending appeal of Circuit Judge Chris Piazza's ruling invalidating the state's ban on same-sex marriage.

Attention now turns to the U.S. Supreme Court, which did not rule on same-sex marriages in the opinions it released today. It has other pending cases that could come Friday or Monday.l

This was the final weekly release of opinions for the summer. But a spokesman for the court told gathered reporters that the justices would be in chambers this summer and could rule at any time on the pending case. But she said she had no specific knowledge when the opinion would be released, but that lawyers in the case would be notified.

Might this be a solid clue that the court is waiting for the U.S. Supreme Court? Perhaps. Though a U.S. Supreme Court ruling, in either direction, doesn't settle a number of state issues that the Arkansas court must decide.

Or is this just the increasingly paranoid and suspicious ruling clique on the Supreme Court just desirous of screwing with people? That's one possibility. Take this to the bank: You won't find the seven Supremes in chambers much during their usual summer recess, whatever the clerk was instructed to tell reporters. But I do think it is right that the decision could be released at any time — this afternoon, tomorrow, next year. Or whenever John Goodson says it's time.
