Medicaid report secret until Wednesday

In answer to a question posed on a link last night:

Yes, a legislative consultant's report on changes to the private option Medicaid expansion was completed by the deadline Thursday by the Stephen Group but it won't be released publicly until a legislative health reform task force meeting at 10 a.m. Wednesday.

Task force members will be allowed to view copies in the Bureau of Legislative Research offices Monday and Tuesday, but not take copies. Rep. Charlie Collins said he wanted members to study it before the meeting and be prepared.

Too bad the public wasn't given the same opportunity to prepare. I was curious how the Bureau of Legislative Research, whose records are generally open under the Freedom of Information Act, was interpreting the law to allow secrecy until next week.

Marty Garrity, director of the bureau, responded about why the report was not already public:

Max, it will be once it is “published.” These are considered the working papers of the chairs of the Task Force and therefore exempt from disclosure. Once the report is published, i.e., made available to no- legislative members, then the report is subject to disclosure under the FOI.
