I have no special knowledge of the Arkansas plan, but it seems likely that this expansion will operate under a special 1115 demonstration waiver. 1115 authority gives HHS the right to waive broad sections of Medicaid law for projects that expand coverage in new ways.

The caveat is that a demonstration waiver has to be budget neutral. The procedure for evaluating neutrality is unclear to me, so the math may be fungible. They may claim that budget neutrality only requires the Arkansas expansion to be cheaper than a regular Medicaid expansion. That sounds like a stretch but maybe there is a way to justify it.
