Rep Davis is on target. ADEQ knows that it's mineral criteria are unatainable for most community and industrial dischargers across the state and they know there's no economically feasible method to remove minerals. They've known this for 10 years but were unwilling to address it by regulation because after all, industries have an unlimited pot of money, right? The problem for the state, EPA and water ratepayers is that ADEQ is now hammering cities and small towns, not just industries most of whom have already spent $100k and more to prove by instream tests that their untreatable and largely naturally occurring minerals have no adverse impacts. There's 40 small towns north of I30 and east of Jonesboro that are now on ADEQs TMDL target list, who will be forced to go through the same multi-year costly process to change 3 numbers on their NPDES permits with ZERO environmental benefit. ADEQs answer? "We'll give you more time." To do what? You CANNOT remove the minerals today or 20 years from now. That whole scheme is an embarrassing waste of tax dollars and ADEQ resources.
