The key question is whether her discretion to conclude that a ballot title is misleading, and thus reject it outright, is essentially unlimited.

I think the idea is just to make a point. They know they can't block Sessions. They're doing this as a public protest. It's grandstanding...but my sense is that Democratic base voters want this kind of maximal resistance and want to see these arguments made in a high-profile, public way.

The surplus is revenues above forecast. If they are below forecast, there is no surplus.

"In the hole" is a reference to the governor's surplus projections, which he relies upon for his highway plan. It's also the case, obviously, that they are going to have to make corresponding budget cuts if they remain below forecast.
