Real estate practices in Arkansas should be made to CLEARLY state on condition reports and title policies the specific terms of any mineral rights. The fact that it's difficult to determine doesn't mean it's impossible to determine. If you're in the title work business this should be and automatic must do on any title search. When you purchase real estate it's ridiculous that someone else owning the mineral rights below your property is not disclosed to you. Paul and Ashley, who did your title work when you bought the property? Ask them why their research was not complete and blame them for your diminished quality of life. Complain to everyone you can about the lack of disclosure of mineral rights when you made your purchase.
