  • Morning minutia: Legislation to protect bank from lawful taxes

Todd Turner, an Arkadelphia lawyer, steps in today for one of those lessons in what's behind one of the dozens of arcane pieces of legislation that sail into law every legislative session with the public none the wiser. Here it's a bailout for big banks at the expense of county government.

  • Jason Rapert, meet Alexander Hamilton

Ernest Dumas this week provides Sen. Jason Rapert (and the Arkansas Democrat-Gazette) with a needed tutorial on what the founding fathers, particularly Alexander Hamilton, wrote about the need for an independent judiciary to protect minority rights.

Re: “Circuit court charge filed against Ten Commandments monument destroyer

Sadly it is illegal for a person to destroy an illegal monument. His bail is 6 times more than the value of the monument. Anyone know if he has an attorney other than a public defender?

Re: “10 Commandments monument at Arkansas Capitol destroyed; suspect in custody for apparent repeat offense

I want a law that requires Rapert (and anyone else who sponsors clearly unconstitutional legislation that wastes tax payer money) to repay the state the full costs of all the state employee time and money wasted on their unlawful endeavors.

Re: “More on the continuing effort to preserve punishing landlord-tenant law

Last time I checked AR also does not have a "warranty of habitability" that every other state has meaning if a landlord rents you a place and the plumbing and electric stop working you still have the obligation to pay even if the place is not habitable.

Re: “Justice in Alabama: Roy Moore ousted from the bench

Conservatives don't care about the rule of law when it goes against their twisted interpretation of their religion. How exactly is that different than ISIS?

Re: “Legislature subpoenas judge to testify about child custody decisions.

DHS proceedings are private and it's a crime to disclose details. I know in the past Senator Clark has claimed to know details of a DHS proceedings that it appears could only be known due to an illegal disclosure. Maybe someone should question him about that?

Re: “Naramore case a long way from over

Why would a judge who has had a tragic life experience with a child be disqualified from hearing juvenile cases? None of us are perfect but during my 22 years as an attorney I've met a couple of judges who think they are. I'm yet to meet anyone who appeared in front of him who had anything but good things to say about him. I noticed his staff at JV court has stuck by his side throughout this whole experience and I know they really want him back. I think that speaks volumes about him as a person and a judge.
