I agree that disclosure and transparency is always good for the political process. Voters and the public interest is always served by more information, not less. Of course, since Citizen United, we have powerful and secret interests shaping and controlling the political process with no accountability and oversight. It happens at every level now. I read about the Koch brothers throwing their money at local school board and city council races.

It is ironic that we now call this money "dark money," when Frontline a few years ago aired a documentary called "black money" about bribes and graft being used to secure foreign contracts in violations of the foreign corrupt practices act. It is hypocritical for the DOJ and FBI to spend resources on this "black money," when political "dark money" is hijacking our political system at a much larger scale.

I agree that Justice Kemp should disclose any significant family connections that might benefit from his position on the Arkansas Supreme Court. Everyone knows about John Goodson, so the voters need to know about Jack Kemp, and if he has relatives or connections at the Mitchell firm he should disclose those. And his daughter should disclose her clients. Lawyers put client lists on their website all the time. That isn't protected as far as I know.

There seems to be a difference between a spouse and a child however. A husband and wife are a team, personally and economically, with aligned interests and goals. Although I am sure Justice Kemp loves his daughter, he probably isn't dependent on her economically and she probably isn't dependent on him. But, since any father wants to see their children succeed, it is fair for him to disclose the connection to his daughter.

I don't see any attorney client issue with transparency. It seems like John Goodson makes his income in class action cases. Those cases are public filings and the fees are public. Someone could research those cases and put together a list of cases and fees. I would think the Goodson campaign would like to get out ahead of the issue and disclose a list before it ends up in an opposition campaign add. There are articles out there showing up to $400 million in attorneys fees made by Goodson since his wife has been on the Court, but that might not be remotely true. If it is true, or even close to true, that kind of money, even the possibility of that kind of money, is enough to test the integrity of even the most solid people. Those are dollars that most people cannot even comprehend.

For me the biggest issue about John Goodson is he does all these class actions that are effected by court decisions. Unlike a lawyer who handles real estate or divroce cases, his business rises and falls depending on what comes out of the Arkansas supreme court. Justice Goodson recuses on a case that her husband appears on, but how does she address cases that her husband does not appear on but might be friends of her husband or might be an issue important to her husbands case? With her husbands line of work, it seems an impossible problem to solve. Maybe John Goodson's move to focus on DC lobbying, if that report by Brantley is true, is an effort to distance himself from Arkansas practice. Maybe John Goodson doesn't even have cases in Arkansas anymore, but I think voters have a right to know that. And if she is transparent, perhaps that will compel Kemp to be transparent.

And yes, if Mark Henry is helping Kemp or acting as a consultant, that is unacceptable for a moral perspective. He has the political right to do so, but if he is hurting Justice Goodson, the mother of his children, then he is putting that above the interests of his children, which no father should do. If he has done that, I hope he reconsiders and stays silent on the race for the sake of his children.
