JB, Judge Hickey's dismissal order can be appealed to the 8th Circuit Court of Appeals in St. Louis.

Splitting it would make for a sensible settlement (assuming you're dealing with sensible people here). However, a major problem appears to be that the woman who cashed in the ticket last year has already spent a large amount of the winnings. So, the question now comes as to whether, if someone else wins the lawsuit (as they did prior to the recent order), are they going to wind up with a mostly uncollectable judgment?

Rule 59 of the Arkansas Rules of Civil Procedure allows a trial court, after entry of judgment, to grant a new trial based upon various criteria that are set forth in that Rule.
