Razorblade have you even bothered to read the opinion prior to spewing your personal moral stance that has nothing to do with any legal issues in this case? If not, I suggest you put forth the effort to at least read the opinion and educate yourself before making an argument that not only is not on point but also address no legal issue discussed in this opinion. If you have put forth the effort to actually read the opinion, you should try to abandon your consceince stupidity and educate yourself on the current state of the law and issues addressed in this case before typing a string of logical fallacies to justify your moral superiority that does nothing to advance this discussion.

A huge class action lawsuit needs to be filed. At least that court order would cover a whole class. I wonder what excuse the Health Dept would come up with to justify the denial of equal rights with a class action court order. Court costs and attorney fees would really sky rocket and the State should be ordered to pay the plaintiffs' legal fees.

This denial only strengthens the constitutional argument that will invalidate Rapert's ridiculous legislation. Meanwhile, Arkansas taxpayers will pick up the tab once again for Rapert's attempt to shove his God down the throats of all Arkansans.

Fortunately, as Max has indicated the Feds save the day. The U.S. Supreme Court is the law of the land like it or not. Under Obergefell, all States and State actors (that includes The Health Department) must not only recognize same sex marriage but also extend the same rights of marriage to same sex couples which includes recognition on birth certificates. The whole point YCHTT is that separate but equal is not equality under the U.S. Constitution. To break this down in simple terms, forcing same sex couples to hire an attorney, pay for filing fees and require a Judge to allow adoption solely on the basis the married couple is not heterosexual is NOT equality and unconstitutional. So the "obvious solution" YCHTT suggests is just obviously unconstitutional. Also the laws of this nation Shall and Must change not May change because the U.S. Supreme Court has ruled. Not that the AR Legislature will stop passing unconstitutional laws, waste time and effort better spent on issues that really need to be addressed and waste a whole lot of tax payer money in the process.
