As a Progressive who believes in aggressively using the constitution to protect previously unprotected rights and does not believe the status quo is well enough to be left alone, I might not have personally appointed Howard Brill Chief Justice at this moment in history, because his world view differs seriously from my own and the paradigms through which we view the world always have some effect on human decision making. But, if we had a system similar to the Federal system, and if I were a legislator called upon to vote on his nomination, I would vote to approve it without hesitation. Howard Brill is a man of integrity, decency, flexibility, compassion, and common sense and a thoughtful scholar of the law, jurisprudence (not the same thing), and legal ethics. He is as impartial as the lot of humanity will allow. Reasonable minds can differ about the interpretation of any text. I might interpret the word liberty more broadly, the general police power more narrowly, or apply strict scrutiny to an arguably suspect classification where he might apply rational basis review. We would probably balance some conflicts between the Free Exercise Clause and the Establishment Clause differently. But Howard Brill is not going to pull out his Bible and put his thumb on the scale on a question of Constitutional or Statutory interpretation. He is not going to stand for county Clerks refusing to issue marriage licenses to people who meet the legal requirements, and he's not going to uphold abortion laws that violate Federal Constitutional precedents, I don't care if he is 'pro-life'. I expect every aspect of the Arkansas Judiciary over which the Chief Justice has any influence or control to either improve or remain steady under his leadership. In fact, my immediate reaction upon hearing of his appointment was "oh thank God". I never would have expected Mr. Hutchinson to make such a wise selection.
