This citation is interesting, but not conclusive. Note the statutory language from that case:
‘The Director shall be chosen on account of his qualifications and fitness for the office, shall be of good moral character and a resident of the State of Arkansas for at least ten (10) years NEXT PRECEDING his appointment.’
Hogan v. Davis 243 Ark. 763, 764, 422 S.W.2d 412, 413 (Ark. 1967). Two words might make all the difference. Then again, they might not. What is clear is that ballot access for a robust political party with a strong national organization and a history predating the civil war hangs by the thread of a single candidate's qualifications. This alone ought to tell us that our ballot access laws are not narrowly tailored to exclude only frivolous parties. Does one of the Big Two actually have to get caught in their own anti-competitive trap before we can see it for what it is?
