Wow! Just read your update Max, and I'm not sure how the SOS fees that were NEVER paid, would be made up for with foreclosure filing fees that ARE NOT PAID in a non judicial foreclosure. That is nonsensical.

Bottom Line: The legislature was ignored by OUT OF STATE BANKS and now the Legislature is being co-opted by the offenders to wash away their own sins, now that the Courts have caught them.

I assume FirstTimeCaller is actually an attorney who is familiar with the relevant cases, since these are the same arguments that have been made by those representing the out of state banks, and more importantly, the same arguments that two judges have found wanting with regard to the relevant violations.

What is really shocking is that the purpose of the section which would be struck by this proposed amendment was to protect Arkansas citizens from abuse by foreign banks who utilized the Non-Judicial Foreclosure process. That stated purpose is in the enacting legislation. That provision has effectively been ignored for years and years by the big out of state banks and their in state lawyers, while people's homes were taken away. Now, that the chickens have come home to roost, they want to change the rules. This is disgusting.

The legislators are there for the citizens of this state, and not to protect the big banks or to allegedly make life easier for the Secretary of State. Ridiculous.
