Don't underestimate this paper's editorial piece on the race which strongly criticized Steele. Smith sent out direct mailers during the runoff campaign directly quoting the Times. The issues raised by the Times weren't on the forefront during the general campaign but seemed to gain traction during the runoff.

I'm a socially conservative, registered Republican, Southern Baptist, and I'm voting for medical marijuana. It's not an issue I'm passionate about either way, but I'm so nauseated by the intellectual dishonesty of Cox and his group. Anyone that spends 30 seconds reading up on the "vending machine" issue can tell right away it only adds a layer of protection against abuse. But Cox goes ahead with misinformation and scare tactics. I'm so tired of garbage like this. If nothing else, my vote will be a "protest" against an unwillingness to debate the issue on its merits.

If Howard wants to bring Benca in he certainly is entitled to attempt to do that. But from the FPD's point of view, few attorneys would welcome another attorney (one they didn't invite) looking over their shoulder, through emails and memos discussing strategy and decisions, etc. I'm just saying the decision to withdraw - especially in light of the fact Howard chose to air this out through Leveritt - is understandable, regardless of who initiated getting Benca involved.

radicalmoney: of course Howard can and should have access to his entire file. That's not the issue. The issue from the FPD's office is giving Benca access.

I don't understand the decision by Leveritt/Howard to publish this timeline on a blog. Benca's motion for reconsideration is still pending. The apparent appeal for public support of Benca's position was assuredly going to further incite the FPD office and will have no impact on Judge Miller's weighing of the issues. Howard is mad at the FPD for engaging Kumpe to advise on its position (which seems to be along the lines of a obtaining a malpractice opinion [which Howard would have no right to okay or deny]) yet gives Leveritt the go-ahead to publicly air out the affair in much greater detail.

From the FPD's standpoint, I completely understand not wanting to turn over confidential work-product to another attorney. If Howard and Benca are demanding that - and they are- no one should begrudge them for deciding to withdraw. Benca could make a tremendous amount of progress getting "up to speed" on the case by simply reviewing the public record and meeting with Howard rather than formally entering an appearance.
