Every parent who adopts a child has to apply for a new birth certificate, whether it's a closed adoption, a step-parent adoption, etc. With the laws clarified, in a closed adoption, instead of having one same-sex parent file a single parent adoption, we will now be able to place both parents' names on the petition for adoption. The Dept. of Vital Statistics said today that the BC would read Parent 1 and Parent 2.
However, if one married female partner gives birth, say using donor sperm, it follows that the new law should allow her same sex spouse to be automatically included on the original BC. This is no different than a heterosexual couple who can't get pregnant using donor sperm. In that case both parents names will go on the BC, because they are married, and in Arkansas, it is presumed that the spouse is the "father", or in this case, Parent 2.
It's not that difficult.
